Charged in New Jersey with Possession of an Out of State Gun?

As an out-of-state gun owner, you may have been arrested in New Jersey for unlawful possession of a firearm. It is a common mistake to believe that reciprocity laws allow you to carry your weapon. However, if you are caught with an unlicensed handgun, you could be charged with a serious second-degree crime. This can happen if your gun is found in your car, at an airport, in a hotel room, or in any other location in New Jersey. If you find yourself in this situation, you need the best legal representation you can get. That’s where the Spodek Law Group comes in.

We have a team of dedicated criminal defense lawyers with the skills and experience to help you navigate this complex legal situation. What You Need to Know

It is crucial to understand that if you were carrying an unlicensed handgun in New Jersey, you will need a Graves Act Waiver to avoid prison time. Spodek Law Group Can Help You Navigate the Rules Governing Possession of an Out of State Gun in New Jersey

If you are an out-of-state resident traveling to New Jersey with your handgun, you need to be aware of the state’s strict firearm regulations. It is crucial to understand the basics of the rules governing the possession of an out-of-state gun. Here are the key things you need to know.

Carrying Your Handgun – N.J.S.A. 2C:39-5b

According to New Jersey law, you can only carry a firearm if you have been issued a permit to carry by the state or are a law enforcement officer authorized to possess a handgun without a carry permit. If you possess your handgun outside your residence in any other context than transporting it to or from a gun range, gunsmith, or the place where it was purchased, you are considered to be “carrying” your handgun. You must have a carry permit to possess the gun in any other context. If you fail to comply, you could face a second-degree crime for unlawful possession of a handgun.

Transporting Your Handgun – N.J.S.A. 2C:39-6g

If you are transporting your handgun, it must be unloaded and stored in a case, gun box, bag, or other enclosure that is outside of the passenger compartment, such as the trunk. The weapon must be separated from the ammunition. If you possess a handgun in violation of this rule, you could be charged with unlawful possession.

Ammunition – N.J.S.A. 2C:39-3f

New Jersey law prohibits the possession of anybody armor-penetrating ammunition, such as hollow tip bullets and teflon-coated ammo. Possessing prohibited ammunition is a fourth-degree crime.

Magazines – N.J.S.A. 2C:39-5j

It is illegal to possess a high-capacity magazine, which is capable of firing more than 10 bullets. Possession of a high-capacity magazine is a fourth-degree crime.

While we understand that these rules may seem harsh, they are the law in New Jersey. Your lack of knowledge, ignorance of the law, or lack of intent will not serve as a defense. If you are facing NJ weapon charges, you need to secure representation from a lawyer who is highly skilled in defending these types of cases.

At Spodek Law Group, our attorney Todd Spodek has the knowledge, experience, and dedication to helping you navigate the complex legal system in New Jersey. Contact us today to schedule a consultation with one of our skilled criminal defense attorneys. We are here to help you protect your rights and your freedom.

Spodek Law Group Can Help You Obtain a Graves Act Waiver to Escape the Harsh Consequences of New Jersey Law

If you are an out-of-state resident facing charges for possession of an unlicensed handgun in New Jersey, you are likely facing the harsh consequences of the Graves Act. This law imposes a mandatory minimum sentence of five to ten years in prison for anyone who possesses a handgun in New Jersey without a permit. However, it is possible to avoid prison time by obtaining a Graves Act Waiver.

What Is a Graves Act Waiver?

A Graves Act Waiver is a legal process that requires the prosecutor to file a waiver on your behalf and get it approved by the court. It is a complicated process that requires the expertise of an experienced criminal defense attorney.
