Why You Need Binghamton Criminal Lawyers

Irrespective of the type of criminal charge you are facing, prosecutors are there to ensure you are convicted. So often it matters little if you are actually guilty of the charge. Their objective is to convict you and sentence you to the severest possible penalties as the outcome. If you wish to evade a relentless prosecution team that is there to bury you, you require an attorney. The average person simply lacks the same legal knowledge and expertise as an attorney, and that can significantly harm the case. When your life is on the line, as it always is when there is a risk of imprisonment, you should not take that risk. Furthermore, when you retain an attorney to represent your case, there is a peace of mind and confidence that would not otherwise be there to cherish at this most difficult time in your life.

Every criminal case is unique. That’s why it’s crucial to sit down and discuss the specifics of your case with an attorney so they can adequately prepare your defense. However, there is little doubt that you’ll want the legal expertise the attorney brings to the case after you discuss your case with them. This is an opportune time to discuss your case with the attorney, receive their recommendations, and otherwise gain assurance in a situation that likely has you stressed to the max. The consultation is the initial step in hiring an attorney to represent you in court. We are ready to schedule your appointment, so give us a call today. If you are looking for a lawyer that listens, is aggressive where needed, and holds his word above all else, Todd is the best pick. I had hired multiple attorneys prior to hiring the Spodek Group for a white collar case. The first thing that stood out to me was the cost, as anyone going through the process and dealing with the system, money was tight at that time - especially after hiring and firing multiple lawyers. The cost was not as high as others which was definitely a plus. Todd's intake process was also unlike other attorneys. He took the time to actually listen. He cared. He was trying to put himself in my shoes while I was explaining the situation to him and he really took the time to understand the whole situation. Other lawyers will give you 15 mins and send you a retainer agreement. Not Todd, I think he spent almost two hours with me as I was explaining everything. Not only was he great during the onboarding process, he was supportive and very informative through the entire plea process and eventually sentencing. After hiring him, I asked if I should hire a prison consultant, he told me to save my money as he would do everything they would. He was right and held up to his word. Later on I would hear from others that went with the prison consultants that they were a waste of money - I am glad I listened to Todd! When it came time for sentencing, two days prior to sentencing, the prosecutor tried increasing my proposed prison time by almost double - apparently a normal move. Todd and his team worked with me non-stop through the weekend prior to sentencing to ensure that I was not given additional prison time. Again, he took the time to listen and came up with a strategy to explain the case with great detail.Unfortunately, I did plead guilty as that was my best option. Todd and his whole team wrote up nearly 300 pages of a summary of what happened and why I should not be given prison time. If I breakdown the amount I spent with Todd versus the amount of work that I saw being done, I am shocked I was not charged four times as much. The other benefit was, a lot of criminal defense lawyers were just a single attorney with a paralegal or two. Todd had a team of people that I dealt with (5-7 people that I interacted with), but he was ALWAYS accessible. It would never take him more than an hour to reply unless he was in court.I was sentenced to prison and I was emotionally distraught. Todd and his team did whatever they could even after sentencing to make sure I was alright. He personally stayed in touch with my family to ensure I was doing alright and offered support to them. Most lawyers would consider the job complete at sentencing, not Todd. After prison, Todd still spent time with me to make sure I was on the right track and avoiding any potential risks in the future. He has also been giving advice on how to navigate probation etc and has not been looking at the clock for billing.Although I wish I had never been arrested in the first place, I am glad I had Todd and his team in my corner. Without them I likely would have had to spend a lot more time in prison than I did.Thank you, Todd, and the entire Spodek Law team, for helping turn what was a nightmare into a manageable situation!

I don’t know where to start, I can write a novel about this firm, but one thing I will say is that having my best interest was their main priority since the beginning of my case which was back in Winter 2019. Miss Claire Banks, one of the best Attorneys in the firm represented me very well and was very professional, respectful, and truthful. Not once did she leave me in the dark, in fact she presented all options and routes that could possibly be considered for my case and she reinsured me that no matter what I decided to do, her and the team will have my back and that’s exactly what happened. Not only will I be liberated from this case, also, I will enjoy my freedom and continue to be a mother to my first born son and will have no restrictions with accomplishing my goals in life. Now that’s what I call victory!! I thank the Lord, My mother, Claire, and the Spodek team for standing by me and fighting with me. Words can’t describe how grateful I am to have the opportunity to work with this team. I’m very satisfied, very pleased with their performance, their hard work, and their diligence.Thank you team!

Binghamton Federal Criminal Lawyers

When it comes to a federal crime, you want the most experienced attorney handling your case. The disparity between a competent lawyer and an ineffectual one can mean jail time or freedom. You don’t want a lawyer who merely recites the law; you need someone with experience in defending clients facing federal charges. The objective is to have the charges dismissed or reduced, and when it comes to courtroom battles, practice makes perfect. No one wants to be a trial run. You want a top lawyer with sharp skills and a comprehensive understanding of the law.

It takes years of practice and working on hundreds of felony cases to develop proper defense strategies. You want a lawyer with a proven track record of success. Federal crimes include, but are not limited to, identity theft, computer hacking, drug trafficking, cyberterrorism, and blackmail. When you have a skilled lawyer on your side, you can rest easy knowing that someone is managing everything for you.

Understanding the Distinction Between State And Federal Courts

If you are suspected of committing a federal crime in Binghamton, then you will likely be charged through the Federal courts. These courts impose more severe punishments, and being accused by the Feds is a grave matter. A Federal matter is distinct from being charged by the state. An attorney knowledgeable in federal crimes can file a motion to transfer the case out of federal court and into the state judiciary.

The Steps in A Federal Case

The legal process entails various steps that each case must follow. The guidance of a lawyer with ample experience is crucial. They can assist you through these junctures and ensure that you receive a fair trial. If you require assistance with federal appeals, our federal appeals lawyers can also aid with this.

  1. A Complaint Is Filed

First, a complaint is submitted. It can follow an arrest, or the arrest can occur after the defendant is served. It’s the prosecutor’s office that files this paperwork and issues the initial grievance. The prosecutor must document all the allegations and present evidence that a crime was committed.

  1. The Defendant Faces the Judge

Once an arrest has been made, the defendant will appear before a judge. The court reviews all the evidence and ensures there is substantial evidence against the accused. If the paperwork is in order, the bail is set, and the defendant is informed of their rights. Obtaining an attorney at this juncture is crucial. While the court can appoint an attorney for those who are indigent, securing proper legal defense necessitates retaining experienced counsel.

  1. The Bond Hearing

A bond hearing is conducted within 72 hours after an individual is arrested. Depending on the offense, a person may be placed under house arrest, required to stay in a correctional facility, obliged to post a bond amount, or released on their own recognizance.

  1. The Federal Court Hearing

After the arrest, the Federal court will conduct a hearing within ten days. During this hearing, it’s the prosecutor’s responsibility to present enough evidence to demonstrate that a crime has been committed. Additionally, the defense lawyer can utilize any evidence they have to establish probable cause. After hearing both sides, the U.S. prosecuting attorney will either accept the complaint or elevate it to an indictment. The evidence collected is then presented to the grand jury to determine if the crime warrants being moved to a federal criminal case or remaining at the state level.

  1. The Federal Arraignment

Following formal charges, an arraignment takes place. All the charges brought against the accused are read, and they learn of their rights. They will be asked to enter a plea of either guilty or not guilty. At this juncture, the court will set the case for trial.

If the prosecutor offers a plea agreement in exchange for information or to resolve the case, it depends on the severity of the charges and whether they are seeking to apprehend any other parties. If no agreement is reached between the prosecutor and the defendant, the case proceeds to trial.

  1. The Trial

During the trial, the prosecutor must prove to the court that the defendant is guilty beyond a reasonable doubt. If found guilty, the individual will be sentenced. Depending on time served and the severity of the crimes, the penalties may include probation, fines, jail time, or a combination thereof.

  1. Appealing the Verdict

If the defendant disagrees with the verdict, they have the right to appeal. Their lawyer must file a Notice of Appeal with the court within ten days of being sentenced. Before accepting any plea deals, it’s advisable to seek proper legal counsel. By entering into a plea deal, the right to appeal to a higher court is forfeited. A knowledgeable federal defense attorney is necessary to protect the defendant during the plea bargain stage. There are no second chances once an agreement has been reached.

Ensuring Proper Legal Representation

The American judicial system is intricate for the average person to grasp. States enforce criminal drug laws, but often the federal government intervenes as well. Many jurisdictions seem to overlap, necessitating agencies to collaborate for successful prosecution. Initially, one may be charged at the state level, and then their case may be elevated to the federal courts.

If you have been accused of violating a federal statute or law, then you need a competent criminal defense lawyer in Binghamton. Whether you have been convicted of violent crimes, drug trafficking, bank fraud, murder, rape, or any other serious criminal offense, you need a skilled attorney to advocate for you. A lawyer will require the pertinent facts of your case and your circumstances to adequately defend you. Never appear before a federal judge without appropriate counsel. It is imperative for your record, and it could mean everything for the rest of your life.
