Who Can File for Child Support in NYC?

In New York, either parent can file a petition in Family Court asking for a child support order[1]. This includes:

  • The child’s other parent (mother or father)
  • Grandparents or other relatives caring for the child
  • Foster parents if the child is in foster care
  • The Department of Social Services if the child receives public assistance

The child can also file for support directly if they are not considered “emancipated” – meaning they are under 21, unmarried, and not self-supporting or in the military[1].

Do I Need a Lawyer for Child Support Court?

While not legally required, having a lawyer represent you in child support cases is highly recommended[2]. The child support laws and calculations can be complex. A lawyer knows the specifics and can help ensure you get a fair outcome.

  • Bills and expenses for housing, healthcare, childcare, etc.
  • Records of any spousal or child support being paid

How is Child Support Calculated in NYC?

New York uses set guidelines to calculate basic child support amounts based on parents’ incomes and number of children[2]. The main steps are:

  • Add both incomes together for combined parental income
  • Deduct FICA, NYC taxes, child support paid for other children
  • Look up the child support percentage based on number of children (17% for 1 child, up to 35% for 5+ children)
  • Apply the percentage to the combined parental income up to $154,000
  • Determine each parent’s share based on their proportional income

This provides a baseline support amount. Additional expenses like healthcare, childcare and education may be added on.

What Happens at a Child Support Hearing?

Child support hearings take place before a Support Magistrate[3]. Both parents have a chance to present evidence and testimony about their finances and the child’s needs.

Some key parts of the hearing include:

  • The Magistrate questions both parents about income and expenses
  • Each parent can testify and call witnesses to support their case
  • Lawyers present documents and other evidence for consideration
  • Parents may rebut or object to the other party’s claims
  • The Magistrate makes a final child support order after reviewing all the evidence

Having an attorney to represent you at the hearing is very helpful, especially if the other parent contests the support request.

How Can Child Support Orders Be Modified?

If there’s a significant change in circumstances, either parent can file to modify the child support order[4]. Some common reasons include:

  • Job loss or change in income
  • Increase or decrease in expenses

  • Child’s increased needs as they get older
  • Change in custody arrangements

The court will look at both parents’ financial situations and the child’s needs when deciding whether to modify support. It’s important to act promptly, as child support can’t be applied retroactively.

What Happens if Child Support Isn’t Paid?

If the paying parent falls behind on child support (called being “in arrears”), the court can take enforcement actions such as[1]:

  • Mandatory wage garnishment
  • Intercepting tax refunds
  • Suspending driver’s license
  • Placing liens on property
  • Reporting non-payment to credit bureaus
  • Jail time in severe cases

The receiving parent can request the court take steps to collect unpaid support. A child support lawyer can help with filing contempt motions and other enforcement remedies.

Interstate and UIFSA Child Support Cases

When parents live in different states or counties, the Uniform Interstate Family Support Act (UIFSA) allows child support cases to be filed across jurisdictions[1].

  • The out-of-state parent is served but doesn’t have to appear in person
  • A local prosecutor represents the filing parent at hearings
