Hey there! Sexual abuse is a pretty serious issue that can really impact peoples’ lives. I wanted to break down New York’s law on sexual abuse in the first degree so we can all understand what it covers.
Under New York Penal Code § 130.65, a person is guilty of sexual abuse in the first degree when they subject another person to sexual contact without their consent. There’s a few ways this can happen:

In all these cases, the adults could be charged with sexual abuse first degree since they had sexual contact with a child under 11. Even though there was no penetration, the sexualized touching of intimate areas is enough.
The main defense to sexual abuse first degree is to show the contact was consensual. But like I said, children under 11 can’t legally consent, so this wouldn’t apply in those cases.For adult victims, if you can show the contact was agreed to and not forced, that would be a defense. It’s important to remember that consent under threat of force or while physically helpless does not count as legal consent.
