I’m Charged with a Federal Crime – How Can a Lawyer Help Me Avoid Prison?

I’m Charged with a Federal Crime – How Can a Lawyer Help Me Avoid Prison?

Getting charged with a federal crime can be one of the most stressful and frightening experiences someone can go through. The stakes are high, and the federal criminal justice system can seem cold and intimidating. But having an experienced federal criminal defense lawyer on your side can make all the difference. Here’s a look at some of the ways a good lawyer can help you avoid prison if you’re facing federal charges.

Negotiating with the Prosecutor

In many federal cases, avoiding prison may depend largely on the plea deal your lawyer can negotiate with the prosecutor. An experienced federal criminal attorney will evaluate the strength of the government’s case and determine what charges you may realistically beat at trial versus what you should consider pleading guilty to. They’ll negotiate firmly but strategically with the prosecutor to secure the most favorable plea agreement possible. This could involve getting charges reduced or dismissed, or persuading the prosecutor to refrain from seeking particular sentencing enhancements. A skilled lawyer knows prosecutors and judges and can guide you in making wise decisions during the plea process.

Presenting Mitigating Factors

If your case does end up going to sentencing, whether after trial or a guilty plea, your lawyer’s advocacy could still keep you out of jail. They’ll thoroughly investigate your background and life circumstances and present “mitigating factors” that cast you in the most favorable light possible. These could include charitable works, mental health issues, family obligations, or other redeeming qualities. Your lawyer will also dispute any aggravating factors claimed by the prosecution and argue persuasively for the lowest sentence permissible. Passionate advocacy from an attorney who knows you and tells your story well could make a judge more inclined to impose probation or home confinement rather than imprisonment.

Federal sentences are largely determined by the complex U.S. Sentencing Guidelines. An experienced federal criminal lawyer will be intimately familiar with the guidelines and adept at using them to your advantage. They’ll identify any errors in the pre-sentence report that could negatively impact your guideline range. They’ll also advise you on steps to take before sentencing, like cooperation with authorities or drug treatment, that could earn you a reduced sentence under the guidelines. And they’ll craft creative departure arguments urging judges to issue a more lenient sentence than the guidelines suggest. Superior knowledge of this convoluted system is invaluable in striving for the most favorable outcome possible.

Making a Strong Case at Trial

If plea negotiations fail and your case goes to trial, a skilled federal criminal defense lawyer’s advocacy in court could be what keeps you out of jail. They’ll employ litigation tactics like filing suppression motions to get damaging evidence thrown out. They’ll aggressively cross-examine witnesses to undermine the prosecution’s case. And they’ll design a trial strategy focused on creating reasonable doubt regarding your guilt. If the lawyer succeeds in beating some or all of the charges at trial, it weakens the prosecution’s hand at sentencing and improves your odds of avoiding incarceration on any remaining counts. Even if convicted at trial, passionate sentencing advocacy from your lawyer could still sway the judge to be merciful.

Pursuing Appeals and Habeas Relief

If you do end up being sentenced to federal prison, your lawyer’s work still isn’t necessarily done. They’ll advise you on potential grounds for appeal that could lead to convictions being vacated or sentences reduced. And if the appeal is unsuccessful, they can pursue habeas corpus relief alleging your imprisonment is unlawful. While rare, prisoners have been released years into their sentences because their lawyers discovered new evidence or constitutional violations. So even post-conviction, a dedicated lawyer keeps fighting for your freedom.
