Federal Marijuana Trafficking: Still a Federal Crime

Here’s what confuses people: marijuana is legal in many states. Medical marijuana, recreational marijuana, dispensaries on every corner in some places. So why are people still going to federal prison for marijuana trafficking? Because federal law hasn’t changed. And in federal court, state legalization means nothing.

Marijuana remains a Schedule I controlled substance under federal law—same category as heroin, classified as having “no accepted medical use” despite state-level medical programs. Federal marijuana trafficking charges under 21 U.S.C. § 841 carry mandatory minimums that can mean decades in prison.

The Federal-State Disconnect

The fundamental issue is jurisdiction. State law applies in state court. Federal law applies in federal court. When you’re prosecuted federally for marijuana trafficking, state legalization provides zero defense. You can be operating a perfectly legal dispensary under state law and still face federal trafficking charges.

Federal prosecutors have discretion about which cases to bring. DOJ policy has shifted over the years—the Cole Memo provided some protection for state-legal operations, then it was rescinded. Current enforcement tends to focus on large-scale trafficking, interstate transportation, and operations that violate state law even where marijuana is legal.

But that discretion isn’t guaranteed protection. If your case involves large quantities, crosses state lines, or draws federal attention for any reason, you face federal prosecution where state legalization is legally irrelevant.

Mandatory Minimum Thresholds

5-Year Mandatory Minimum:

• 100 kilograms marijuana (or 100 plants)

10-Year Mandatory Minimum:

• 1,000 kilograms marijuana (or 1,000 plants)

These thresholds are higher then other drugs in absolute terms, but marijuana operations often involve substantial quantities. A modest grow operation can easily reach 100 plants. Interstate shipments frequently exceed 100 kilograms. The mandatory minimums catch more defendants then you might expect.

Prior conviction enhancements apply. Under 21 U.S.C. § 851, prior drug felonies double mandatory minimums. Two priors can trigger life without parole even for marijuana-only offenses.

Where Federal Marijuana Cases Come From

Federal marijuana prosecutions typically arise from:

Interstate trafficking: Moving marijuana across state lines creates federal jurisdiction. Even transporting from one legal state to another triggers federal exposure.

Large-scale operations: Multi-state distribution networks, industrial-scale grows, operations with firearms or violence.

Federal lands: Grows on national forest land or other federal property.

Financial crimes: Bank fraud, money laundering, tax evasion connected to marijuana operations.

Task force cases: DEA task forces occasionally prosecute marijuana cases, particularly those connected to other drug trafficking.

Defense Options

Safety Valve: First Step Act expanded safety valve eligibility. If you meet criteria (limited criminal history, no violence, full disclosure to government), judge can sentence below mandatory minimums.

Role Reductions: Large marijuana operations have clear hierarchies. Trimmers, transporters, and peripheral workers often qualify for 2-4 level guideline reductions.

Fourth Amendment: How was the grow discovered? Aerial surveillance, traffic stops, confidential informants—all create suppression opportunities.

Entrapment: If government agents induced you to commit crimes you weren’t predisposed to commit, entrapment is a defense.

The Changing Landscape

Federal marijuana law may change. Bills proposing decriminalization or rescheduling have advanced further then ever. Some defendants have received clemency. But until Congress acts, federal marijuana trafficking remains a crime with serious mandatory minimums.
