As someone who’s been through this process myself, I want to walk you through what to expect and give you some tips so you can go into it with confidence.

What is a Federal Grand Jury?

A federal grand jury is a group of 16-23 citizens who review evidence to decide whether to bring criminal charges against someone. The prosecutor presents documents, physical evidence, and witness testimony to the grand jury [1]. Everything that happens there is secret, to protect the reputation of the person being investigated if no charges are brought. There’s no judge and no defense lawyers in the room – just the prosecutor, witnesses, court reporter, and grand jurors [2].

Your Rights in the Grand Jury Room

If you have evidence relevant to the case, you must provide it to the grand jury so they can make an informed decision about charges. However, you have the right under the 5th Amendment to avoid self-incrimination by remaining silent [3]. You cannot be punished for invoking this right.
