Penal Code 148.4 PC – Making a False Fire Alarm in California

What Constitutes a False Fire Alarm in California?

In California, making a false fire alarm is a crime punishable by law under Penal Code 148.4 PC. This law covers actions like tampering with fire protection equipment, setting off fake fire alarms, and making false fire reports. To secure a conviction, the prosecutor must prove that the defendant acted knowingly and maliciously. A willful act means that the defendant acted willingly and on purpose. Malicious behavior means that the defendant acted with the intention of committing a crime or causing harm to someone else.

At Spodek Law Group, our experienced criminal defense attorneys recommend three powerful defenses to fight a Penal Code 148.4 PC charge. First, a defendant can demonstrate that they did not behave deliberately, which is a necessary element to secure a conviction under this law. Second, a defendant can prove that they did not act with malice. Finally, a defendant can demonstrate that they were unjustly accused of breaking the law.

Penalties on Conviction for Making a False Fire Alarm in California

Most false fire alarm offenses in California are classified as misdemeanors. If convicted, the defendant may face up to one year in county jail and/or a maximum fine of $1,000. The court may also sentence the defendant to misdemeanor probation instead of jail time. However, if a false fire alarm causes grave bodily harm or death to another person, the offense becomes a felony punishable by up to three years in jail and/or a fine between $500 and $10,000.

Expunging a PC 148.4 Conviction from Your Record

A person convicted of a misdemeanor under Penal Code 148.4 PC can have their conviction expunged if they successfully complete their jail sentence or probation, whichever was imposed. A felony conviction can also be expunged if it does not result in a sentence to state jail.

False fire alarms are closely related to other crimes like false reports of an emergency (California PC 148.3), making a false police report of a crime (California PC 148.5), and false identification to a police officer (California PC 148.9).

At Spodek Law Group, our skilled attorneys have successfully defended clients accused of making false fire alarms. If you face a false fire alarm charge or have any questions, we invite you to contact us today for guidance and legal assistance.

Examples of False Fire Alarms in California

False fire alarms come in various forms, and some examples of false reports of a fire in California include:

Breaking into a store and destroying a fire extinguisher.
Interfering with a smoke detector in a Los Angeles school.
Setting off a fire alarm as a prank.
False fire alarms can be costly and put lives at risk. Thus, it is critical to understand the legal consequences of making a false fire alarm in California.
