In the Golden State of California, the roads are not always safe from the grasp of criminal hands. Three crimes make up the spectrum of motor vehicle theft – Grand Theft Auto, Carjacking, and Joyriding. Each offense is considered serious, with severe penalties if convicted.
Penal Code section 215 reveals carjacking as a felony offense – the forceful or fear-inducing act of taking a vehicle from someone’s possession. Whether it’s from the driver or a passenger, the intention is to temporarily or permanently deprive the owner of their property.
Penal Code section 487(d)(1) is clear, theft of a vehicle is considered Grand Theft Auto in California. It’s a “wobbler” offense that can be charged as either a misdemeanor or a felony, depending on the circumstances.
Vehicle Code section 10851 defines Joyriding as the unauthorized taking of someone else’s vehicle. It’s also a wobbler offense and may result in either a misdemeanor or a felony charge.

Grand Theft Auto convictions may result in a maximum of three years in prison, with additional time added if the value of the vehicle is over $65,000 or $200,000. Joyriding convictions may result in up to 12 months in county jail if charged as a misdemeanor, or up to three years if charged as a felony.
