Schedule III Controlled Dangerous Substances (“CDS”)

Understanding Schedule III Drugs Under New Jersey Law
Under N.J.S.A. 24:21-7, Schedule III CDS is defined as any substance that:
- Has a potential for abuse that is less than those listed in Schedules I and II
- Has currently accepted medical use in treatment in the United States
- Abuse may lead to moderate or low physical dependence or high psychological dependence
The substances listed in Schedule III are subject to revision and republishing by the director under subsection d. of section 3 of P.L.1970, c. 226 (C.24:21-3), except to the extent provided in any other schedule.
Types of Schedule III Drugs in New Jersey
CDS falling under Schedule III in New Jersey includes any material, compound, mixture, or preparation that contains any quantity of the following substances associated with a stimulant effect on the central nervous system:
- Amphetamine, its salts, optical isomers, and salts of its optical isomers
- Phenmetrazine and its salts
- Any substance that contains any quantity of methamphetamine, including its salts, isomers, and salts of isomers
- Methylphenidate
Similarly, any material, compound, mixture, or preparation that contains any quantity of the following substances having a potential for abuse associated with a depressant effect on the central nervous system is also listed under Schedule III:
- Any substance that contains any quantity of a derivative of barbituric acid or any salt of a derivative of barbituric acid, except those substances that are specifically listed in other schedules
- Chlorhexadol
- Glutethimide
- Lysergic acid
- Lysergic acid amide
- Methyprylon
- Phencyclidine
- Sulfondiethylmethane
- Sulfonethylmethane
- Sulfonmethane
- Ketamine hydrochloride
Nalorphine is also included in Schedule III.
Narcotic Drugs in Schedule III
Schedule III also contains limited quantities of narcotic drugs, including:

Exemption of Certain Compounds, Mixtures, or Preparations from the Application of the Law
The director of Schedule III CDS may, by regulation, exempt any compound, mixture, or preparation containing any stimulant or depressant substance listed in subsections c. and d. of this schedule from the application of all or any part of the law. However, the compound, mixture, or preparation must contain one or more active medicinal ingredients that do not have a stimulant or depressant effect on the central nervous system. These admixtures shall be included in such combinations, quantity, proportion, or concentration as to vitiate the potential for abuse of the substances that have a stimulant or depressant effect on the central nervous system.
