New Jersey Law & Penalties: Possession or Distribution of an Imitation Drug
The state of New Jersey takes drug offenses very seriously. The penalties for possessing or distributing a fake or simulated controlled dangerous substance (CDS) are particularly harsh, given the potential harm to the public that could result from someone attempting to sell or use such substances.
Under N.J.S.A. 2C:35-11, possessing or distributing a simulated CDS is a third-degree crime, punishable by up to five years in prison and a fine of up to $200,000. Additionally, as with any CDS conviction, a mandatory driver’s license suspension of six months to two years may be imposed.
The law provides three scenarios that may constitute evidence of a violation of N.J.S.A. 2C:35-11, including packaging of a substance in a manner that would normally be used for the unlawful distribution of an illegal drug, the attempt or actual distribution of a simulated substance along with a demand for money or consideration, and possessing or distributing a substance whose physical appearance is substantially the same as a form of controlled dangerous substance.
