Arson Overview

Arson is defined under the law as the willful and malicious act of burning or charring property. This well-known crime is committed for a number of reasons, from the practical (Insurance fraud) to the psychologically unbalanced (Pyromania). The defense for arson will be contingent on the reasons a defendant might have been charged with the crime in the first place. In many instances, a defendant is accused of a crime they simply did not commit. In arson, it’s up to us – the defense – to prove that you didn’t start the fire. The degrees of arson are consulted before someone is charged with a crime. Each degree carries with it a specific burden of proof. For example, in 1st degree arson, someone sets fire to a home that is occupied by people. This is far more serious 3rd degree arson, where a defendant is accused of setting fire to an abandoned space where people aren’t present. The reasons are obvious. It’s a greater threat to society when an arsonist sets fire to a home or building, knowing that people could lose their life in the fire.

Penalties For Arson

The penalties for 1st degree arson will be steeper than that for 2nd degree arson and 3rd degree arson will carry the lightest penalties. In some jurisdictions, any degree of arson is a felony, while in other areas prosecutors have the choice to file it as a misdemeanor, depending on the severity of the arson that took place. And keep in mind that you don’t have to burn someone else’s property to be guilty of arson. One of the most common reasons for arson is to destroy your OWN property in order to collect insurance money. In this instance, you destroy your own property, but it’s still arson. There would also be other charges filed along with this complicated scenario.

Penalties for arson include:

– Imprisonment (By far the most common, especially if you’re convicted of a felony example of arson)
– Fines
– Restitution
– Court ordered classes (If the arson was the result of an underlying mental condition)

To show you how serious the penalties for arson can be, take for example Oklahoma law. There, if you’re convicted of 1st degree arson, you can receive up to 35 years in prison and a fine of $25,000. This is a very serious crime and you should never plead guilty to it before consulting our lawyers.

Perhaps the most common defense for arson is to simply proclaim your innocence.
