Being an active part of the United States Military requires making numerous sacrifices. It means leaving your family when commanded. It means leaving the country to protect the states and putting your life on the line. It also requires you follow an entirely different set of rules and laws than the ones you followed before you enlisted in the military. Unlike a regular civilian job where you’re free to quit when you’ve had enough or decide to go back to school to pursue another dream, you’re not free to do so when you enlist in the military. You can’t just quit. Your job is to stay put until your contract is up, which is usually years.
If you leave at any point prior to your contract ending, you are considered a deserter or an unauthorized absentee, and you will find yourself in more trouble than you ever imagined. Military law does not allow for anyone enlisted in any branch to simply fail to show up for their job or leave at will. It’s called deserting, and it’s illegal. You might not just lose your job, you might go to jail and you might be dishonorably discharged. This can have a lasting impact on the rest of your life and your ability to get another job once you return to civilian life.
As a member of the military, you know AWOL is short for absent without leave. This means you’re not present doing the job you’re scheduled to do without permission to leave. It’s also referred to as deserting, and it’ll illegal. When this happens, the rest of your life could be ruined thanks to your enlistment, and you want to call a military attorney to help you navigate these waters. It’s a slippery slope, and it can cause the rest of your life to take a very negative turn.
The laws are strict in the military. The purpose of these strict laws is to maintain order. When you have people who put their lives on the line every day for this country, you have to trust they are doing their job and following orders without question. When even one person shows a disregard for their job, for the command, and for the rules, it’s a problem. It’s a problem because it puts the lives of everyone else in their command at risk. If someone fails to show up for duty, it puts everyone else’s lives at risk. That’s why the military makes these rules so strict.
It’s strictly illegal to go AWOL for even one day. You’ll suffer severe punishment if you do this even once, but that might not be the worst. If you’re missing for more than 30 days, you can expect the law to come down hard on you. You will have a warrant out for your arrest. If you are located during a traffic stop, applying for a job anywhere else, or even walking down the street, you could be arrested. You could go to jail, but you’ll likely be shipped back to your command and punished within the confines of the military. This often includes confinement, which is one of the worst things you can experience.
Call an Attorney
If you’ve been accused of deserting or going AWOL, it’s time to call a military attorney to help you with your case. It’s our job to fight for an administrative discharge rather than legal punishment. Our expertise and experience assisting military personnel who have gone AWOL for any length of time is impressive, and we are able to help you get what you want out of this rather than confinement or even jail time.
The one caveat is you will more than likely return to military service while this situation is sorted out. Your job might entail you follow strict instructions without falling out of line even once during this time while we work your case to receive a discharge from the military without legal consequence. It’s not ideal for you, but it’s much better than confinement and dishonorable discharge for desertion. This can prevent you from ever securing a job again, and that means your entire future is on the line.
