MCA Default, Rental Applications, Car Leases and Employment: Which Records Matter?
Delancey Street offers an initial consultation about business debt and MCA concerns. The company is not a law firm; legal matters require independently licensed counsel. Services and eligibility depend on your circumstances and the written engagement.
Discuss Your Options: (888) 559-0156National Debt Relief
National Debt Relief describes services for eligible unsecured business obligations. Its published qualifications distinguish unsecured accounts from debts supported by collateral. Confirm that the particular account qualifies and ask what support is available if litigation begins.
CuraDebt
CuraDebt describes assistance with eligible business obligations, including some merchant cash advances. Its service disclosures explain that inquiries may be connected with independent providers or law firms. Establish who will perform the work and review that provider’s engagement, fees, and eligibility requirements.
It Depends Which Record They Look At
The short answer is that it depends which record they look at. A landlord or auto leasing company may read your personal credit report, but MCA defaults don’t automatically show up there. A civil judgment no longer sits on consumer credit reports, but tenant screening companies and public record searches can still find court cases. Employers need your written consent. Even with written permission, state laws may limit what they can check and how they use the information.
There are actually three separate places your information could be. The personal credit report, business credit report, and court public record are each slightly different. MCAs are mostly approved on revenue and bank statements, not credit. A business report is not a copy of your personal one. None of these three elements are automatically tied together, but there are ways that a merchant advance could become visible in any one of them.
There isn’t one consistent policy by which every MCA you might take out goes on your personal or business credit report. To find out, ask your funder if and where they report an MCA. Even if you signed a personal guarantee, your own credit history may be unaffected. A UCC filing is a lien, not payment history.
While signing a personal guarantee could give the funder legal recourse in case of default, that’s separate from the question of reporting. If a collector threatens to report, ask them for the name of the company, the account number, the basis, and keep a copy of all this for your records.
As of July 1, 2017, Experian, Equifax and Transunion only add a public record to a personal credit history if it includes a name, address and either a Social Security number or a date of birth. After the consumer reporting agencies changed their rules in 2017, the CFPB found no one in its sample had a civil judgment on their record with a credit bureau. That does not mean your judgment is gone. The court deadlines and enforcement still apply, and your business credit report, tenant screening searches and other public record searches do not share the same rules. But information about a past default or judgment may still be relevant, whether the MCA went on your personal credit report or not.
A Credit Check
Your landlord can run a credit check on your credit report when you apply. Tenant screening companies collect court records by automation. Generally, they verify only if they’re alerted, say you dispute it, or your landlord asks for a manual check. A landlord must also give you a notice if, based on the report, it denies you housing, requires a co-signer, or wants you to pay more rent or a bigger deposit. That notice says you can get a free copy of the report if you ask within 60 days. If that notice comes, ask for the free copy. See what case or account it lists and dispute anything wrong, since a dispute is often when screeners double-check the record by hand.
When you seek to lease a car, the leasing company may check your personal history. If an MCA debt goes to collections and the collector reports it, it can sit on your personal record for up to 7 years. The clock for that begins when your account becomes 180 days delinquent. If your funder did not report, the auto lease underwriter might see nothing about the prior merchant advance. Check your report to see if anything has actually reported before applying for the car lease.
When you pay an MCA off, there is no automatic way that creates positive payment history on your reports. If your funder never sent updates to the bureaus, payoff does not start new reporting. Paying it down still adds stability by ending any daily cash withdrawals. Ask for a payoff statement, settlement letter and lien release to store as your records.
Employers can only check your personal credit history with your written permission. Before rejecting you for a job based on the credit report, your employer must give you a copy of the report and your legal rights notice. Seven-year limits don’t apply if the job pays $75,000 a year or more. Most New York City employers also can’t use credit history in hiring. A New York State law said to take effect April 18, 2026 bars any New York employer from using credit history in hiring, with some narrow exceptions.
Your MCA problem rarely boils down to a credit score alone. Is the problem in an inquiry, an account, a filing or a court case? Gather together the signed agreement and guarantee, the credit report or collection notice, payment records and any papers in a lawsuit.
Before you apply, it is smart to pull both your personal and business credit reports, and have them handy. Compare any entry with your agreement and payment records. Don’t stop payments to test a reporting claim. If you have been served, deal with the case promptly.
