Title VII of the Civil Rights Act of 1964 provides workers with the legal right to do their jobs in work environments free from discrimination and harassment based on their membership in the protected classes of race, color, religion, national origin and sex. Since 1964, the classes of workers who are protected under federal law have been broadened to include those with disabilities and others who may suffer discrimination in the workplace. Employment law also provides that employees who feel they may have been, or are being, discriminated against may not be retaliated against for formally complaining about the discrimination.
Many states have taken federal employment laws and refined them to give employees more rights and avenues for addressing discrimination in the workplace. Both federal and state law require that workers exhaust an administrative process before proceeding to court when discrimination occurs, and the process for a federal claim generally differs from a state’s claim process. For example some states, such as California, allow for the administrative process to be initiated online and an immediate request to proceed to court, while others require an in-person interview to begin the process.
A worker in one of the protected classes who believes they have been, or are being, discriminated or retaliated against may not be aware of their rights under law. They may also not know how to proceed with the filing of a formal claim should their situation warrant it, or the time limitations within which a claim must be filed. In consultation with a labor and employment attorney, they may be able to learn whether what they have experienced rises to the level of employment discrimination under law. An attorney may also be able to help an employee with a legitimate discrimination case identify documents and witnesses to support their claim, as well as help them file their claim on time.
