Whether the debt settlement company is down the block from you or across the country, it does not change the most critical factor: The rules in your state. A debt settlement firm across the street may feel like the right choice, simply because it is the one with which you would have a face-to-face relationship. Unfortunately, when it comes to debt settlement law and debt settlement companies, your feelings may be steering you in the wrong direction.
There is a federal regulation that says you do not have to pay until a written settlement exists and you have gotten a debt paid down. Trouble is, that rule only covers telephone sales. What this means is that if you are sitting face-to-face with the company’s salesperson when you sign, you may not be covered by this rule.
The Fee Rule Can Differ State by State
States can each make their own laws. If any debt settlement company charges you fees before it settles your debt, it violates North Carolina’s debt adjusting law, which protects consumers from unfair debt adjustment practices. Specifically, it means that in North Carolina, it is criminal for debt adjustment companies to charge up front fees. The prohibition is strong, because what happens if it is broken is strong. Violators are charged with a Class 2 misdemeanor. A firm that collects an unauthorized fee may face penalties of being shut down. It may face the appointment of a receiver who takes over the firm’s assets and returns money not yet paid to creditors, as well as a demand for civil penalties.
One catch: The state defines a debtor as an individual who lives in North Carolina. That may mean that business borrowers can’t get its protection. There are exceptions in the law. Lawyers licensed in North Carolina who are not affiliated with a debt adjusting firm are exempt, as are accredited credit counselors that charge a set up fee of $40 or less and 10% of monthly payments (capped at $40).
Other states have regulations about what a debt settlement company may charge, such as if it acts as your paymaster to your creditors. What it is, is a service that takes your money that month and divides it up into payments that it then sends to your creditors. Under Georgia law, it can’t charge more than 7.5% of your monthly payments, and must send the money to your creditors within 30 days.
The law in California gives you the right to cancel the contract with your debt adjuster at any time. There’s no termination fee, either. If you don’t use certified mail, it takes effect 7 calendar days after your letter is mailed.
Under 2026 rules, debt resolution services serving Tennessee consumers need a license first and a surety bond to a max of $50,000. But not so for Tennessee-licensed lawyers who serve clients with a debt problem. If a company does not have an in-state license, find one that does, no matter how far away it is.
Merchant Cash Advance
Many of these rules seem to be written for consumer borrowers. Your debt may not be that simple. Until recently, Texas had not regulated an important business lender, the merchant cash advance lender. Now, it does. Texas authorized the Office of Consumer Credit Commissioner (OCCC) to register companies that make merchant cash advance loans, with a December 31, 2026 deadline. Since July 9, 2026, a lender must be the big man on the block if it wants to debit the small guy’s account automatically. The big guy has a first priority perfected interest in every receivable.
In New York, since 2019, a law has been in place that forbids creditors from being able to file confession of judgment papers against businesses that are not in New York and don’t have a presence there.
Read anything you sign. Some companies ask you to save money that you otherwise would have paid on a bill in a dedicated savings account that you will use to pay what you owe. The federal rule also means you must own and control that account. If you leave, you get the unused balance back within 7 business days, minus fees already earned.
None of this means that the down-the-street company automatically has the wrong offer for you. What it does mean is that choosing the right one takes more information than what is nearest. Above all, before you sign anything, ask questions about which state or states would cover you, and your debts under a debt settlement company’s contract.
