Professional misconduct cases begin with an investigation by OPD. Investigators will send you a letter, or ask for a call, to discuss the allegations. Often, an investigator will cold call you and attempt to discuss an ethically questionable situation with you. Regardless of how they do it, you shouldn’t speak to OPD without an attorney. You have the right to legal representation, and it’s important to have an attorney at the very beginning of the legal investigation. Once the investigation is done, formal charges might be recommended by the investigator to the Board. If the Board accepts the recommendation, formal charges are initiated, and the matter is submitted to the OPD prosecutor.
