Probable Cause: The Foundation of a Valid Search Warrant

According to the Fourth Amendment of the United States Constitution, specific criteria must get met for a search warrant to be valid. The amendment states that only if there is probable cause supported by an affirmation or oath describing the particular place and items or persons that will get seized can a judge issue a valid warrant. Therefore, citizens are protected from unreasonable seizures and searches.

Probable cause refers to reasonable grounds for suspicion based on facts and circumstances known at the time of issuance of the warrant. Officers have to swear out an affidavit detailing their probable cause before presenting it in front of a federal judge who may either deny or grant them permission.

It’s crucial that all procedures get followed when filling out a search warrant because even minor errors could put an entire case at risk of invalidation. Here are some requirements for establishing probable cause:

– There should be probable cause that a crime has occurred.
– There should also be probable cause indicating that evidence related to said crime exists within specific locations.
