The Los Angeles Annulment Lawyers at the Spodek Law Group are here to help you with your legal issues. If you are looking for an annulment, we can help you. Separating couples may sometimes pursue an option of ending their marriage known as an annulment. While an annulment and a divorce both accomplish the basic purpose of ending a couple’s union, these two processes have very different eligibility requirements and effects. It is important to understand the difference between an annulment and a divorce before making a decision about which process to pursue.

The annulment process is a legal declaration that a marriage is null and void, rendering it as if it never existed. The court’s decision to grant an annulment is based on certain grounds, such as fraud, duress, physical or mental incapacity, incest, and bigamy. In California, the process is similar to that of a divorce, with one party bringing a petition for annulment and bearing the burden of proof to show the judge that the grounds for annulment existed at the time of the marriage.

However, not all marriages are eligible for annulment. It is important to consult with a reputable annulment lawyer, such as the experienced attorneys at the Spodek Law Group in Los Angeles, to determine if your marriage meets the legal requirements for annulment. Our team can provide you with a thorough evaluation of your case, explain your rights and options, and guide you through the process of preparing a compelling and accurate petition.

Don’t let your marriage be a trap, an annulment may be the solution you need to move on from a relationship that was never legally valid. It’s a chance to start fresh and put the past behind you. But it’s important to act quickly and efficiently, otherwise, you may be forced to proceed with a divorce. Contact us today and let us help you take control of your future.

Annulments are granted for a variety of reasons, including:
1. Lack of Capacity to Consent: If either party was unable to understand the nature of the marriage contract or give consent due to mental incapacity or intoxication, an annulment may be granted. This includes marriages entered into by minors without parental consent.
2. Fraud: If either party misrepresented themselves in some material way in order to induce the other party into marrying them, an annulment may be granted. For example, if one person lied about their ability to have children, this could be considered fraud.
3. Force: If either party was forced into marrying against their will, an annulment may be granted. This can include physical force as well as psychological coercion.
4. Bigamy: If either party was already married to someone else at the time of the marriage, an annulment may be granted.
5. Incest: If the parties are closely related by blood, an annulment may be granted.
6. Lack of Physical Consummation: If the marriage was never consummated, either because of impotence or unwillingness, an annulment may be granted.
