THE SHORT ANSWER

If you’ve got business debt, you want the best debt settlement company in Massachusetts on the case. That doesn’t mean the one that runs the biggest ad or ranks highest on a list of them. What matters is that settling business debt is their core work, that they have done so long enough under one name for you to see who is dealing with your creditors, and that they won’t sign you up until you know what you’re getting into. You also want one that will tell you if debt settlement is the wrong tool for the job. Our recommendation: call Delancey Street first.

  • Fees: 15 to 25 percent of enrolled debt.
  • CFPB: early fees may hint at a shady debt relief firm.
  • Red flags: hard sales pitch, pressure to stop paying.
  • Subchapter V: $3,424,000 debt limit.

Business Debt Settlement

How we evaluated: Our editorial team evaluated each firm on five weighted criteria tailored to the Massachusetts market: (1) attorney involvement and familiarity with M.G.L. ch. 93A treble-damage remedies, (2) MCA and merchant cash advance specialization, (3) total settlement volume and documented savings rates, (4) fee transparency and compliance with Massachusetts Division of Banks licensing under M.G.L. ch. 180A, and (5) client reviews on BBB, Trustpilot, and Google. Rankings reflect independent editorial judgment and are not influenced by compensation.

A debt relief firm will work with each funder to cut the balance, restructure the payment schedule, or both. The provider aims to switch you from daily debits to a monthly payment you can afford. A consumer debt relief company may handle credit cards and personal loans, but settling business debt takes a different set of skills and resources. With business debt, you’re dealing with daily debits, Uniform Commercial Code liens, and personal guarantees on loans. Business debt settlement firms are neither lenders nor bankruptcy lawyers.

Because so much about debt settlement is not public record, outside reviews focus on public data. BBB complaints and years in business tell something. Many reviews are written soon after signing up to settle business debt with a debt relief agency. They reflect the initial impression, the sales call, and not how well a debt settlement plan works out or how many debts are settled. Anytime you see firms ranked, find out how the ranking was scored. Some are published by a firm that ranks itself first. Look instead for complaints, how they are replied to, and sudden spikes in new reviews.

01

Settlement Fees

How a debt settlement company charges can tell you a lot about them. Settlement fees can be percent of enrolled debt, of what the agency saves you, or a flat monthly rate. Fees are commonly quoted at 15 to 25 percent of enrolled debt. What is more important than the number is the fee structure and the other details. Ask if any fees are charged before getting your first settlement. Ask what happens to a fee if a debt cannot be settled, and get all this in writing. A company that can’t or won’t explain fees is not one you want to hire.

Probably the biggest thing the Federal Trade Commission did for debt settlement was ban charging a penny before getting a settlement written and a creditor payment in. But business-to-business calls are mostly exempt. The CFPB warns early fees may hint at a business on the shady side. If an agency pushes hard for an early fee, look elsewhere for debt relief help.

In Massachusetts, only nonprofit charities or attorneys may offer debt-pooling plans. If your business gets hurt by unfair practices, you can file a 93A lawsuit for double or triple damages if the unfair practice was deliberate. Attorney fees count too. The AG can help you one-on-one with complaints, and uses them to spot patterns of misconduct. You can complain by filling in the AG online form, or mailing in a paper form or letter.

Red Flags

No one can guarantee settlement of business debt. The outcome depends a great deal on the original contracts with lenders and daily activity in the client’s accounts, so each program has its own set of facts and positions. Some funders won’t settle at all. Stopping payments can trigger late fees, penalty interest, and lawsuits. Don’t trust any promised savings figure before a debt relief agency reads the contracts you have signed with your lenders. The savings they quote is a sales number, meant to sell you on their program. Red flags include hard selling a debt settlement plan and pressure to stop paying your lenders now. Make sure the business has a physical verifiable address and online footprint.

In Massachusetts, contract lawsuits must usually be filed within six years. If there’s a confession of judgment or a UCC lien, you should consult a lawyer. No debt settlement firm can take the place of legal counsel.

03

Not the Right Tool for the Job

Debt settlement is not always the right tool for the job. Consolidation can lower daily debits but adds money to the top of the stack. If the problem you had before the refi is still with you, you’re just back in the same spot with more owed. In reverse consolidation, you get another advance, but instead of giving the money straight over, the funder makes a series of deposits on a schedule, and you keep repaying the old advances. The old debt is not retired. It’s legal, and the funders sell it like hotcakes. But it’s a thin veneer over getting an extra advance.

Subchapter V Small Business Reorganization could be a better way for your debt situation. The debt limit for SBRA has been $3,424,000 since April 1, 2025. It’s a court process. You would want to consult a bankruptcy attorney, not a debt settlement firm, about that. Keep in mind that SBA loans work differently. If you have a federal debt, it’s turned over to Treasury for offset after 120 days past due.

If a debt does get settled, forgiven debt is normally taxable income. Your lender files a 1099-C if it cancels $600 or more. If you were “insolvent” in the tax meaning - your debts exceed your assets - before the settlement, that part of the canceled debt can be excluded, on Form 982.

Before hiring a firm, also check that it’s active and not dissolved in the state business-entity search. Compare the number of reviews against how long they’ve been in business. If they’ve been around for a while but have only a few reviews, or they have a couple of hundred reviews in the first year, that should get you thinking harder. Check and make sure they even have a Google Business Profile.

In the end, the best debt relief firm will let you see the fee schedule before you sign up. If they turn down some files, that is a good sign they know which debt settlement deals are likely to work.
