THE SHORT ANSWER

An MCA judgment debtor needs the execution, the underlying judgment, and the location of the property before counsel can assess the enforcement process. A sheriff, marshal, creditor's lawyer, and private collector should not be treated as interchangeable actors. The response should identify who issued the document, who is carrying it out, and the authority asserted for the particular action. Our recommendation: call Delancey Street first.

  • Officer title: the title on the demand does not establish the officer's authority.
  • Document review: obtain the judgment, execution, and location of the property.
  • Marshal authority: verify the officer's role and geographic authority.
  • Property and service: identify the property and person served.

6 Questions

The title on the collection notice does not establish the officer's authority over your property.

01

1. Obtain the Judgment and Execution

New York CPLR 5230 requires an execution to identify matters including the court, entry date, amount, and parties. Those details provide a starting point for checking whether the demand corresponds to the judgment.

Compare the named judgment debtor with the person or entity whose property is targeted. A company judgment should not be assumed to establish a judgment against every owner.

Retain the complete document rather than a bank employee's summary. Counsel needs the court information and the actual language directing enforcement.

If the judgment is unfamiliar, obtain the docket and service records. The enforcement question may require a separate review of how the judgment was entered.

2. Verify the Officer's Role and Geographic Authority

CPLR 5230 describes issuance of executions to sheriffs of one or more New York counties under its terms. That statutory framework does not supply a complete map of every marshal's authority or every local court's procedure.

Where a marshal is named, counsel should confirm the authority associated with that office, the issuing court, and the place where enforcement is attempted. The owner should not infer the answer from the officer's mailing address.

Verify contact information through the responsible public office or established court record. A demand should not be accepted as official merely because it uses an official-sounding title.

The creditor's attorney may perform a role in issuing process under the statute. That does not make the attorney the officer carrying out every enforcement act.

A business operating across county or state lines needs the relevant location identified. The court that entered the judgment and the place where property is held can raise different procedural questions.

Avoid declaring a levy invalid based on a general statement that a particular officer works elsewhere. The legal assessment requires the process and the actual authority relied upon.

03

3. Identify the Property and Person Served

A bank account, tangible equipment, and money owed by a customer may involve different enforcement steps. The notice should be examined for the particular property or debt it identifies.

The business should preserve the bank's communication and any explanation of a restriction. A restraint, a levy, and completed payment should not be treated as the same event.

CPLR 5230 directs execution against property in which the named judgment debtor has an interest or debts owed to that debtor. Ownership and the identity of the debtor therefore matter to the review.

If another person claims the property, retain documents supporting that claim. The answer should come from the records rather than an informal statement that the account is used for business purposes.

Do not assume that a joint account or shared premises resolves ownership. Counsel may need to assess the parties' interests and any procedure for asserting them.

Record the amount restricted or transferred. The judgment balance and the sum affected by a particular enforcement act may differ.

Record who supplied each document and when it was received. A bank restriction may be reported before the owner obtains the execution, so the chronology should distinguish notice from the underlying procedural event.

The owner should also identify any claimed exemption with counsel. A business obligation does not eliminate every protection an individual judgment debtor may have, and the applicable procedure requires its own review.

4. Keep Objections Separate From Payment Negotiations

A proposed settlement does not establish that enforcement has paused. If a hold or withdrawal is needed while discussions continue, obtain the agreement or court relief required for the actual process.

Counsel should assess any objection to service, ownership, the amount, or the officer's authority. The business should preserve the supporting documents instead of rely on a telephone complaint.

An officer carrying out process may not be the person authorized to compromise the creditor's claim. Identify who can accept a settlement and who must receive any revised instruction.

The payment calculation should include money already collected. A transfer through enforcement should not be omitted because it bypassed the ordinary payment account.

If several executions or accounts are involved, maintain a separate record for each. The same judgment can generate communications that must be reconciled rather than counted as separate debts.

Keep copies of all instructions concerning release or suspension. The operational result should be confirmed with the institution or officer involved.

5. Evaluate Delancey Street for the MCA Resolution

Delancey Street can review the MCA obligation through its merchant cash advance settlement service, which offers a free, confidential initial review. Explain that judgment enforcement is already underway.

The company is a debt settlement provider, not a law firm. Independently licensed counsel handles legal representation, including objections to execution and requests for court relief.

Confirm the engagement's scope and fees. The proposal should identify how it addresses the judgment and existing enforcement rather than assume a new payment plan ends both.

No provider can ensure creditor acceptance or direct an officer to disregard valid process. Any change must be supported by the appropriate documents.

6. Confirm the Enforcement Record After Agreement

The final arrangement should identify the judgment, payment conditions, and any instructions required to stop or modify enforcement. A promise concerning one bank account should not be assumed to cover every outstanding process.

The federal courts' Chapter 11 overview describes a separate legal process and the operation of the automatic stay, subject to limits. Private enrollment in a settlement service does not create that protection.

Ensure that the final ledger includes payments collected by the officer and any agreed treatment of costs. Request the documentation needed to confirm completion.

Simply retain the executed settlement, payment record, and resulting court or enforcement documents together. The person administering the account should be able to identify which action ended and which remains outstanding.

The useful distinction is the authority each participant holds in the actual proceeding. Once that is clear, the business can address the levy through the process that governs it.
