THE SHORT ANSWER

An information subpoena should be answered through its actual procedure, even while the debtor disputes the creditor's account of the case. A business owner needs to identify the recipient, questions and deadline before treating the paper as another request that can wait for settlement negotiations. Identify the document, name, date and legal status. Our recommendation: call Delancey Street first.

  • An information subpoena: it has a procedure and deadline separate from other requests.
  • The recipient: it can be a business, its owner or a third party with information.
  • Third-party certification: it can be required when the recipient is not the debtor.
  • Response: it should be tied to the records, not invented or revised to suit the dispute.

7 Questions

An information subpoena should be answered through its actual procedure, even while the debtor disputes the creditor's account of the case. A business owner needs to identify the recipient, questions and deadline before treating the paper as another request that can wait for settlement negotiations.

01

1. Is This an Information Subpoena or a Different Request?

New York CPLR 5224 distinguishes an information subpoena from a subpoena for records and one requiring attendance for an examination. The owner should identify the instrument received rather than assume that every creditor inquiry has the same requirements.

The information-subpoena procedure includes written questions, a copy and original, and a prepaid addressed return envelope. Preserve the complete packet so counsel can review its form and service.

A letter asking for a financial update should not be treated as identical to a statutory subpoena. The response depends on the document and the legal basis asserted.

Keep the envelope and any delivery record. Those details can matter to the date from which the response period is measured.

2. Who Is Required to Respond?

Identify the named recipient and compare it with the judgment debtor. A business, its owner and a third party possessing information can occupy different positions under the rule.

For an individual, the statute calls for answers by the person served. For the specified business entities, it contemplates an officer, director, agent or employee with the information.

Counsel should determine who is the appropriate respondent for the actual entity and request. The employee who opened the mail should not assume that receiving the envelope makes every question a matter of personal knowledge.

Keep the distinction between company information and individual information visible. A request directed to one should not be expanded or narrowed based on an informal assumption about what the creditor must have intended.

If the business has changed management, identify who holds the relevant records. The current owner's lack of memory does not establish that the information is unavailable.

03

3. What Date and Form Govern the Answer?

Under the written information-subpoena procedure in CPLR 5224, answers are made under oath, address each question separately and are returned with the original questions within seven days after receipt. The rule supplies no universal list of seven questions that every funder must use.

Read the actual questions and identify the records necessary to answer them. A response prepared from memory can create errors that the account documents would resolve.

Before assuming an extension, before relying on a settlement conversation to postpone the response, obtain advice on the actual procedural position. An unaccepted request for more time should remain identified as such.

Simply preserve the final response and proof of its delivery. The owner should know what was sent and when, rather than rely on a recollection that someone handled it.

4. Does a Third-Party Certification Requirement Apply?

For qualifying subpoenas directed to someone other than the judgment debtor, CPLR 5224 requires the creditor or attorney to certify a reasonable belief that the recipient has information assisting collection. The provision contains conditions and exceptions that counsel should examine.

The rule states that an applicable third-party information subpoena lacking the required certification is null and void. The recipient should first confirm that the requirement applies to this paper and this role.

Separate a Defect From the Response It Requires

A possible objection should receive legal review before the recipient decides to disregard the document. A mistaken assessment of the recipient's status can undermine an assumption that the certification was required.

The statute also identifies a procedure for a qualifying third-party recipient to seek to quash a subpoena in the court that issued the underlying judgment. Counsel should assess the grounds and the necessary application.

Retain the document as served. A later corrected version should not erase the record of the earlier paper or the dates associated with it.

Address Scope and Accuracy Through the Records

If a question appears to seek information outside the recipient's role, identify the concern for counsel. The appropriate response should distinguish a legal objection from an inability to locate a record.

Do not invent an account balance, omit an asset or describe a transfer inaccurately because the creditor's purpose seems unwelcome. The answer is part of a legal process.

Resist the urge to provide a narrative accusation in place of the requested information. Counsel can review and analyze disputed issues while the factual response remains tied to the questions.

An extremely useful preparation file shows the record supporting each answer. The business should be able to explain where the information came from if a later question concerns the response.

The paper may be short. Its request for an oath should receive the attention the small packet does not command.

5. How Does Settlement Affect the Subpoena?

Delancey Street offers a free confidential initial review of MCA concerns. An owner considering settlement should provide the subpoena and judgment documents as part of the account's current position.

The company provides debt settlement services and coordinates legal matters with independent counsel. It is not a law firm. Responding to process and seeking court relief require the appropriate attorney engagement.

Ask the adviser to ensure that the proposal recognizes the pending subpoena. Counsel should ensure that any claimed extension, withdrawal or modification is supported by the necessary action.

Review fees and who is responsible for the legal response. Private enrollment should not be treated as permission to miss the statutory schedule.

A creditor's willingness to discuss payment does not establish that every outstanding process has been withdrawn. The accepted arrangement should identify what changes.

Identify whether the settlement contact has authority to address the subpoena. A representative discussing installments may need the creditor's attorney to handle pending process. The owner should retain the actual confirmation rather than assume that everyone communicating for the creditor has made the same commitment. That distinction matters when the commercial discussion continues beyond the response date.

6. What Records Should Remain After the Response?

Keep the subpoena, supporting records and exact answer together. Retain correspondence concerning any objection or accepted change.

Forward new papers to the assigned professional. A later request may require separate review.

7. What Happens if the Information Remains Disputed?

Counsel should examine any follow-up process and the procedure for addressing it. The business should preserve its records rather than revise the underlying history to match a preferred explanation.

An extremely favorable settlement proposal may remain incomplete if pending disclosure obligations are left unresolved. Delancey Street's review can address the debt discussion while counsel handles the process, with each response grounded in what the document requires.
