What Not to Do If You Are Under Federal Investigation

Getting that knock on your door from federal agents is scary stuff. Your first instinct might be to panic, but it’s important to stay calm. I’m here to walk you through some big no-no’s so you don’t make things worse.

Don’t Talk to the Agents Without a Lawyer

You have the right to remain silent and you should use it. Anything you say can be used against you. Be polite but firm that you won’t answer questions without your attorney present. This is not the time for chit-chat.[1]

Don’t Let Agents Search Your Home or Office

Federal agents may try to get your consent for a search so they can gather evidence. Politely refuse unless they have a warrant. Obstructing their investigation by hiding or destroying evidence is illegal, but you aren’t required to help them.[3]

Don’t Try to Explain Your Side of the Story

You’ll get your chance later if charges are filed. For now, keep your mouth shut no matter how much you want to defend yourself. Anything you say can come back to haunt you.[2]

Don’t Make Public Statements

Resist the urge to post on social media or speak to the press. This can compromise your defense strategy down the road. Let your lawyer do the talking.[4]
