Anyone who is a victim of domestic violence involving physical, verbal, emotional or any other forms of abuse can obtain a temporary restraining order. A TRO is a court order that protects a victim by demanding the abuser to stay at least 100 yards away from the victim. The abuser can be arrested if they come within 100 yards of the victim. A TRO can be filed against anyone who initiates the abuse regardless of their relationship to the victim.
Victims of abuse should first call the police so that the police can write a report and protect them from further abuse. If the abuser calls the police when the courts are closed, the police can issue a TRO that will remain in effect until the courts open on the next business day. The abused must present their case in court where a judge will typically issue a TRO that same day. Then, an Order to Show Cause hearing will be scheduled where both parties can appear in court to explain why a permanent restraining order is needed or why there shouldn’t be a permanent restraining order.
