TITLE IX RIGHTS FOR ROTC STUDENTS – LAWYERS
Title IX of the Education Amendments of 1972 is a powerful tool for protecting individuals from discrimination on the basis of sex in any educational programs or activities that receive federal funding. This groundbreaking legislation ensures that students and employees of these programs are protected from a wide range of discriminatory behaviors, including sexual harassment and assault, which can rob individuals of their right to equal access to education. Additionally, Title IX prohibits retaliation against those who speak out against discrimination, making it a crucial safeguard for ensuring fair and equal treatment in the educational arena.
However, it’s important to note that there are some exceptions to the scope of Title IX. For example, institutions whose primary purpose is training individuals for military service are not covered under the legislation. This raises the question: does Title IX apply to students and participants in ROTC programs? The answer is yes, it does. ROTC programs offered at colleges and universities across the country are covered under Title IX, as are instructors and other employees at these institutions.
At our law firm, we have extensive experience working with Title IX and ROTC, and we are committed to providing detailed and accurate information about the application of this important legislation to ROTC members at American colleges and universities. Whether you are a student, instructor, or other employee in an ROTC program, we are here to help you understand your rights and how to protect them. With Title IX on your side, you can be confident that you will be treated with the fairness and respect you deserve.

Let us guide you through the complexities of Title IX and help you achieve the justice you deserve.
When a student, whether they are enrolled in ROTC or not, is accused of violating Title IX, the educational institution launches an investigation into the claims made against the accused. Though the investigation may appear similar to a criminal investigation, it is not the same. Those accused of criminal misconduct are protected by rights guaranteed by the U.S. Constitution, while those accused of an on-campus offense may not always be afforded the same rights. In an educational investigation, only a “preponderance of evidence” is needed to determine whether the accused is responsible and should be disciplined, a much lower standard than that required for a criminal conviction.
The consequences of a Title IX violation can be severe, potentially altering and damaging the course of an individual’s life. For ROTC students, the outcome of an investigation can lead to being disenrolled from ROTC, losing an ROTC scholarship, and even ending their plans to join and serve in the military. In some cases, a ROTC student may be required to serve in the military without pay or be forced to repay an overwhelming amount of money to the federal government if deemed to be in breach of their ROTC contract.
If you’ve been accused of a Title IX violation, it’s crucial to contact an attorney as early as possible in the process. Even though the investigation system does not function like a criminal court and people charged with offenses are not entitled to legal representation, a skilled and experienced advisor can offer advice and guidance on how to protect yourself and how to proceed. Without assistance from someone who knows what’s happening and how to guard against the potential for due process violations, the accused person is vulnerable to a system that could substantially damage and even ruin their life.
