Tax fraud is a serious crime. Each year, more than 1.5 million taxpayers are audited for potential irregularities in their tax returns, potentially indicating a risk of being prosecuted. Of those people who are audited, only 13 percent will eventually be totally cleared by the Internal Revenue Service. This means that 87 percent of those audited will, at a minimum, be required to pay some form of penalty or back taxes.
However, of those 1.5 million, only around 1,500 will ultimately be convicted of any form of criminal tax fraud. Usually, people who end up being convicted of tax fraud have egregiously violated the tax law in one form or another. This usually involves deliberately concealing how much money they have earned or falsifying information regarding deductions. There needs to be a clear intent to defraud the government, and almost everyone who is convicted of tax fraud has displayed multiple red flags for fraudulent behavior, including non-cooperation with auditors and providing information that is later shown to be false.
Because so few cases are actually referred to the IRS’ Criminal Investigations unit usually around just —3,000 per year for the whole country — if your case has been referred for prosecution, you absolutely must hire a tax fraud attorney. The IRS now considers you to be a tax cheat and will prosecute you to the fullest extent of the law.
The penalties, fines and sentences for being convicted of tax fraud are truly horrific. You could end up spending up to 5 years in federal prisons, be forced to pay $250,000 in fines and have penalties of more than 100 percent of the back taxes assesses. In addition, you may be required to pay years of reassessed taxes.
