If you’re facing incarceration in New York, it’s understandable to feel hopeless and discouraged. However, there’s a program that might give you a second chance at freedom. NY Shock Incarceration, a six-month rigorous program, can help you qualify for release if you meet certain eligibility criteria. Here’s what you need to know about the program and whether you qualify.

Who Qualifies for NY Shock Incarceration?

To be eligible for NY Shock Incarceration, you must meet the following criteria:

Be eligible for parole or conditional release within three years
Be under 50 years of age
Have no previous convictions for violent felonies in New York or any other state
Have been between 16 and 50 years of age when you committed the crime

NY Shock Incarceration: What You Need to Know

NY Shock Incarceration is not for the faint of heart. It is a rigorous program that involves physical exercise, substance abuse counseling, GED classes, and vocational programming. But where is it offered? And how does one apply?

Where is NY Shock Incarceration Offered?

At the moment, there are only two designated Shock Incarceration facilities in New York: Lakeview Shock Incarceration Correctional Facility and Moriah Shock Incarceration Correctional Facility. If you’re hoping to participate in the program, you’ll need to be placed in one of these facilities.

How Does One Apply for NY Shock Incarceration?

There are two ways to be eligible for NY Shock Incarceration: court-ordered and facility-ordered. Let’s look at each in turn.

Court-Ordered Shock Incarceration

If you’ve been sentenced to prison, the court may order you to participate in the Shock Incarceration program. However, it’s worth noting that many prosecutors will insist on a waiver of NY Shock Incarceration as part of a plea bargain. This means that even if you’re eligible for the program, you may need to waive your eligibility in order to accept the plea deal.

Even if the court orders you to participate, the screening committee will still need to assess your medical and mental health conditions to determine if you’re able to complete the program.

Facility-Ordered Shock Incarceration.

If you’re not court-ordered to participate in the program, you can still apply to the Shock Incarceration screening committee for permission to participate. The committee will review your application and determine if your participation is consistent with the safety of the community and your own well-being. If they decide that you’re a good fit for the program, they’ll forward your application to the Department of Corrections Commissioner for approval.

Participation in Shock Incarceration Program

Once you’re accepted into the program, you’ll need to sign an agreement stating that you accept the terms and conditions of the program. Participation in the program is a privilege, not a right, and it can be revoked at any time at the discretion of the commissioner. You’ll need to successfully complete the entire program in order to receive a Certificate of Earned Eligibility and be conditionally released.

The program involves intensive programming that starts at 5:30 – 6 AM and finishes at about 9 – 9:30 PM each day. But if you’re willing to put in the work, the rewards can be great.

Certificate of Earned Eligibility and Conditional Release

Assuming you successfully complete the program, you’ll receive a Certificate of Earned Eligibility and be conditionally released. However, keep in mind that any behavioral violations could result in your participation being terminated and your release being revoked.

Ineligibility for Conditional Release at the Completion of NY Shock Incarceration

At the completion of the program, you’ll be eligible for a conditional release, but there are certain circumstances that could make you ineligible. For example, if you have an out-of-state or federal felony warrant, a felony arrest warrant that isn’t barred by the statute of limitations, or another definite sentence that will have to be served in NY State local custody, you won’t be eligible.

If you have an open felony charge in New York State, the committee will need to inquire about the status of the case. If the case is still open and within the statute of limitations, your release will be granted. If there’s no response within 30 days
