Why Everyone Needs a Prenuptial Agreement: Protect Your Future with Prenups

Entering into a marriage is one of the most precious moments in an individual’s life. You only want to focus on your future together with your significant other, and it may seem like prenuptial agreements are far from your mind. However, while everyone enters into a marriage hoping it will last forever, you must consider the possibility that things might not work out. Therefore, focusing on your future should be part of planning for this beautiful union.

A prenup is a legal contract signed by you and your partner before getting married. It details your assets (including degrees) and liabilities while ensuring that both parties are honest about their financial status. A prenuptial agreement addresses possible spousal support or division of money and property when death or divorce occurs. Though these areas already have set laws within New York State, entering into a prenup puts control of them in the couple’s hands instead of the state’s.

Although the Uniform Prenuptial Agreement Act has been enacted by several states across America, it is yet to be adopted in New York; hence New York state law outlines requirements for such agreements. These include needing to be written, signed well ahead of the wedding date, fair (not utterly unfair), notarised, implemented voluntarily (with no pressure), and containing accurate information.

Prenuptial agreements aren’t just for wealthy individuals as many think they are designed to protect anyone if their marriage fails. Here are some matters that can be addressed in such agreements:

Protecting Individual Property

Any asset acquired before entering into marriage is typically referred to as individual property/ separate property brought during marriage which differs from joint or marital property acquired together as couples usually share what they acquire jointly. Hence when drafting a prenup document, all applications involving separate property need to be specifically outlined so such assets’ division is clear should marriage dissolve in the future.

Addressing Debt

Most people have some form of debt. However, a prenuptial agreement tackles how any significant prepaid debt brought into the union shall be managed should they eventually divorce. The document will declare such and ensure that it remains with each party instead of being transferred to one spouse or another in case of separation.

Provisions for Children

Where a spouse has under-aged children from a previous relationship/marriage who haven’t been adopted by the present partner, provisions must be made for them. A prenuptial bond is critical as it will also ensure the provision of financial support to your children if you divorce or after death occurs.

Support Provision

If one spouse chooses not to pursue their career or opts to become a stay-at-home parent, then couples may choose to have provisions in their agreement addressing compensation during the period when this arrangement persists. Additionally, it can address specific aspects related to spousal support payments, frequency in which they would be paid (if necessary), amongst other things, should a divorce occur.
