You’ve worked tirelessly to earn your medical license, pulling through grueling years in residency and gaining the respect of your peers. Explaining The OPMC

Got a call from OPMC and drawing blanks? It’s okay! Many physicians in New York aren’t familiar with this agency. The OPMC is the organization mandated by law to explore cases of professional misconduct involving doctors and physician assistants across New York.

The Heavy Consequences

Adverse findings from OPMC really pack a punch. They’ve got the power to dish out penalties such as:

  • Revoking your license
  • Fully or partially suspending your license with or without conditions
  • Annulment of your license
  • A fine of up to $10,000 for each charge of misconduct
  • Public reprimand
  • Prescribing extra education and training

What’s The OPMC Process?

The OPMC process is a winding road. Here’s typically how it goes down:

First, someone lodges a complaint about you with the OPMC. Then the agency takes up the case for investigation, legally allowed to pull up records, call in witnesses for questioning, and do a thorough examination of the claims. Often, the OPMC will contact you, usually seeking an interview or requesting access to certain patient records. And while you’re legally obliged to provide the requested documents, you may or may not agree to an interview. Listen to this part carefully: it’s a wrong move to talk to the OPMC investigators without first consulting with a legal expert.

Moving Forward With The Investigation

If the OPMC finds basis in the accusations against you, the case proceeds to the Investigation Committee. At that juncture, your case could take different turns. Triggered by the committee’s recommendation after reviewing the initial investigation, the case could be closed, sent for further investigation, or escalated to warrant a physical or psychiatric evaluation of you.

In the gravest of cases, a formal administrative hearing might be put on the calendar. Often, many doctors opt to negotiate Consent Agreement to avoid this formal encounter. Scarily, in instances when doctors pose immediate danger to public health or have felony convictions, the Department of Health could put your license on ice even before the hearing.

Can You Appeal?

You must be wondering, “Can I appeal an unfavorable OPMC decision?” The straight-up answer is – Yes! There exist two paths to overturn a decision; firstly, an administrative appeal to the Administrative Review Board (ARB). According to the official laws and regulations governing the OPMC, both you and the State can appeal to the Board, typically within 45 days of tabling legal briefs. Consisting of three doctors and two non-medical professionals, the Board’s decision process is arbitrated by an Administrative Law Judge. If this fails to produce the desired outcome, the second route is opting for judicial appeal, which involves moving an Article 78 action in the Appellate Division of the New York Supreme Court.

Should the OPMC come calling, it’s important to remember one thing: “Don’t panic and call me, Todd Spodek!” Sure, you must cooperate, but that doesn’t mean trampling on your rights.
