All people who live and work in the United States of America are required to follow the laws in place by the states and by the government as a whole. The laws are easy to learn, they are taught in school, and they are made abundantly public to anyone who has any question whether their activities might break a law. Common sense comes into play in most instances, but there are always instances in which people have no idea they are breaking the law. In addition, there is a lot more at stake for anyone who enlists in the United States Military.
Every branch of the military requires all enlisted personnel to follow very specific laws. These laws are the same as the ones civilians are required to follow, but some laws are stricter. The military does not work like any other employer in the country. They require all people enlisted follow the law precisely and exactly, and they issue much stricter and more serious punishments for those who fail to abide by the law. Working for the military and breaking the law is a dangerous combination that might affect the rest of your life. If you are accused of a crime while enlisted in the military, you want to call a military criminal lawyer to help you with your case.
What is Larceny and How is it Punished?
Larceny is defined as the “wrongful taking and carrying away of the personal goods of another from his or her possession with intent to convert them to the taker’s own use,” in the official dictionary. Anyone to steals anything is charged with larceny. Depending on the size and value of the item, the charges range anywhere from petty larceny to grand larceny. Some larceny is a misdemeanor and some larceny is a felony.
For example, if someone in the military steals a pair of $75 shoes from a department store, it’s considered a petty theft, which is a form of misdemeanor larceny. It typically comes with a sentence of up to 60 days in jail as well as a fine not to exceed $500. If the shoes are a pair of $700 designer shoes, the charge is upgraded to grand larceny. This comes with a potential sentence of up to 5 years in prison and a fine not to exceed $5,000. If the item stolen is valued at more than $20,000, it’s grand theft. This results in one of two punishments.
You could spend up to 15 years in prison if the grand theft is second degree, and you could spend up to 30 years in prison if it’s first degree. The fines for each are both $10,000 or less. It’s a serious punishment, and those enlisted in the military face additional punishments. For one, you might be confined for an undetermined amount of time. You might also be dishonorably discharged, which means your entire future is affected.
A dishonorable discharge from the US Military goes on your permanent record. This affects your ability to get a job, to get a home, and to provide for your family. You lose your military benefits such as insurance and your retirement, and your entire future is jeopardized.
Call an Attorney
If you are an enlisted member of the United States Military with a larceny arrest to worry about, it’s time to call an attorney. A military attorney can help you defend your case whether you were on duty when you were charged of this crime or off. It’s our job to help you overcome the accusation of larceny by defending your case the way you want.
We can help you reduce the charges brought against you or even have them dismissed. We can help you convince the military to issue lesser punishments, and we can fight for you. The military is tough because they have a zero-tolerance policy for criminal activity. They need their recruits to be trustworthy and obedient at all times to ensure the safety of all people enlisted, and they come down hard on everyone convicted of a crime to set an example. Let us help you prove your case and stay out of trouble.
