Basic Allowance for Military Housing is a benefit offered to many men and women in the military when there’s no other housing available to them. It’s a system designed to provide funds to the enlisted party so he or she and their family can find a home to live in outside of the military base at which they are stationed. The allowance allows the family to pay for a home without using money out of their own pocket since that’s not something they’re required to do when they live and work on base. It’s an allowance that makes life just a little more affordable for the men and women in the military as well as their families.
Any family who needs housing and cannot live on base is permitted to apply for BAH, and anyone who travels for their work is able to apply for transportation costs in addition. For example, an enlisted member of the military who is required to travel for work and pays for their own travel expenses can request reimbursement for their expenses. It’s commonly done in every branch of the military, and sometimes members of the military are accused of lying on their paperwork for additional income. It’s called BAH and Travel Fraud, and it’s illegal.
BAH and Travel Fraud Penalties
Anyone who is accused of this kind of fraud faces serious legal trouble. Military law is different than civilian laws. There are different requirements, and many people find they have to face additional charges. If you are found guilty of fraud of any sort in the military, you’ll be subject to grand larceny charges, intent, and even false statement charges.
You could face jail time, fines, and you could be dishonorably discharged. This means you are released from your duties in the military and sent to live in the civilian world without any of the benefits you would have otherwise received if you were honorably discharged. This is a negative situation in more than one way. You can lose your housing allowance, your job, your pension, your retirement, and your insurance. Your family suffers, and you’ll find it’s difficult to obtain a good job outside the military with a dishonorable discharge as well as a criminal record.
Defending BAH and Travel Fraud Penalties
There are always people who do intentionally defraud the government on these forms, and those people are punished to the full extent of the law in most instances. However, there are also people who simply make a mistake, do not fill out paperwork correctly, or simply didn’t understand what these lengthy forms were asking. This happens more than you might imagine, and it’s dangerous.
Even if you do not intend to defraud the government, you could face charges and a court martial might still find you guilty. Perhaps all you did was write the wrong amount in the wrong box, fail to fill out a portion of the paperwork, or you added too many expenses that aren’t eligible for reimbursement. If this happens because you simply make a mistake or misunderstand what’s being asked of you on the papers, you shouldn’t suffer for the rest of your life.
Everyone makes mistakes, and our job is to stand by you and help prove you did not intend to defraud the United States government. If you did not intend to defraud the government, you cannot be charged with anything criminal. However, you might still face lesser charges. It’s the job of a military lawyer to help you prove you did nothing of the sort.
Calling an attorney can help you fight charges of criminal intent as well as dereliction of duty, which is the failure to properly ensure forms were submitted. You cannot undo your mistakes, but you can prove that’s all they were. You never know what might happen unless you work to prove your case. Let us help you do that by working with you to obtain your statement and evidence, and let us help you find a way to remain innocent of all charges when the United States Military accuses you of BAH and/or Travel Fraud.
