Fraud and abuse of federal funds is a big problem. Estimates show it costs taxpapers billions of dollars every year. Luckily, there are laws to protect whistleblowers who report fraud and abuse. This article explains the main whistleblower programs.

What is a Whistleblower?

A whistleblower is someone who reports misconduct, fraud, or abuse. They are basically calling attention to wrongdoing. There are laws to encourage and protect whistleblowers who report fraud against the government. It’s dangerous to be a whisleblower. You can face retaliation like getting demoted or fired. The laws protect whistleblowers from retaliation.

Main Laws Protecting Whistleblowers

There are a few main laws that protect whistleblowers who report fraud and abuse of federal funds. Here’s an overview:

  • False Claims Act (FCA) – This is the main law used to prosecute fraud against the government. The FCA lets private citizens file lawsuits on behalf of the government against companies that commit fraud. How Whistleblower Programs Work

The process for whistleblower programs works like this:

  1. A whistleblower reports fraud, abuse, or misconduct to the government.
  2. The government investigates the allegations.
  3. If the investigation leads to fines, settlements or convictions, the whistleblower gets a percentage of the money recovered.
  4. The whistleblower is protected from retaliation under the law.

For example, under the False Claims Act a whistleblower files a “qui tam” lawsuit alleging fraud against the government. The Department of Justice joins the lawsuit to investigate the company. If DOJ recovers money from the company, the whistleblower can get 15-30% of the recovery. Pretty sweet deal!
