Nevada Federal Attorneys

By Spodek Law Group | February 15, 2023

Why You Need a Nevada Federal Criminal Defense Lawyer

If you are facing federal criminal charges in Nevada, you need a skilled and experienced federal criminal defense lawyer to guide you through the complicated legal process. The consequences of a federal conviction can be severe, including long prison sentences and hefty fines. Therefore, it’s critical that you have an aggressive and knowledgeable attorney who is familiar with the federal court system and the laws that govern it.

The Procedure for Federal Charges in Nevada

The legal process for federal charges in Nevada is complex and can be daunting. It involves several different steps, and each step can have a significant impact on the outcome of your case. Let’s take a closer look at the procedure for federal charges in Nevada:

Step 1: The Complaint

The first step in the process is the complaint. The federal prosecutor will issue a complaint that outlines the specific reasons for the charge and provides probable cause to arrest the defendant. The complaint will then be used to obtain an arrest warrant from a federal judge.

Step 2: The Arrest

Once the arrest warrant is issued, the defendant will be arrested and taken into custody. After the arrest, the defendant will have the first court appearance where they will appear before a judge who decides whether there is sufficient evidence to indict them. The judge will also set a bond and inform the defendant of their legal rights.

Step 3: The Preliminary Hearing

Within ten days of the arrest, a preliminary hearing will occur. During the hearing, the federal prosecutor will present evidence of probable cause that the defendant committed the crime. The defendant’s criminal lawyer will also be given an opportunity to present evidence that will challenge probable cause. If the judge decides there is sufficient probable cause, the case will proceed to the arraignment process.

Step 4: The Indictment

The prosecutor can decide to file an indictment, rather than a complaint. In this case, they will present probable cause to a grand jury, which will decide whether to prosecute a federal criminal case. If the grand jury decides there is enough evidence, they will return a True Bill. If not, they will return a No Bill, and the case will be dropped.

Step 5: The Arraignment

At the arraignment, the defendant will be informed of their rights and enter a plea of guilty or not guilty. A date for the trial will also be set. If the case proceeds to trial, the prosecutor will have to prove all the elements of the crime to obtain a conviction. The jury will ultimately make the decision, and if the defendant is found guilty, the judge will sentence them in the sentencing stage of the process.

Step 6: The Appeal

The last stage of the process is an appeal, which must be filed within ten days. This is a crucial step in the process, as it can give you another chance to challenge the conviction and reduce or eliminate the charges against you.

Protecting Yourself from Federal Crimes: Understanding Federal Law Enforcement Agencies

When it comes to federal crimes, there are several law enforcement agencies that investigate them. These agencies have the power to investigate a wide range of criminal activities, including wire fraud, kidnapping, cyber crimes, and public corruption, among others. The Federal Bureau of Investigation (FBI), the Drug Enforcement Agency (DEA), and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) are the most common agencies involved in investigating federal crimes.

If you are facing charges for a federal crime, it is crucial to understand the role of each agency in the investigative process. The DEA, for example, is primarily concerned with drug crimes, while the ATF focuses on weapons, arson, explosives, and violent crimes. Understanding the jurisdiction of each agency is critical in building an effective defense strategy.
