Drug Distribution Charges: How a Drug Crimes Lawyer Can Reduce Your Sentence

Drug Distribution Charges: How a Drug Crimes Lawyer Can Reduce Your Sentence

Getting charged with drug distribution can be scary. The penalties are harsh, and include long mandatory minimum sentences. But a good drug crimes lawyer can help reduce your sentence using specific defenses and legal strategies.

Distribution charges cover selling, transporting, importing, exporting, administering, giving away, or simply possessing large quantities of illegal drugs. Even peripheral involvement like driving someone else carrying drugs or letting them store drugs at your house can lead to charges if prosecutors argue you aided the crime.

Mandatory Minimum Sentences

One of the biggest challenges with distribution charges are mandatory minimums – set sentences you have to serve based on the type and weight of drugs involved. For example, just 5 grams of meth carries a 5 year minimum sentence. 50 grams bumps that up to 10 years. These minimums apply regardless of whether it’s your first offense.

Prosecutors will weigh drugs to trigger the highest possible mandatory minimums. A good lawyer will look for errors in these measurements, like including the weight of packaging, that can lower the mandatory minimum.

Defenses Against Distribution Charges

Several legal defenses can also help avoid or lower distribution sentences:

  • You didn’t know you had the drugs – For example, they were hidden in a borrowed car. Lack of knowledge can negate possession.
  • You weren’t trying to distribute – If you had a large quantity of drugs just for personal use, not selling, sentences may be lower.
  • You were coerced – If you were threatened or blackmailed into transporting drugs. Highlights you weren’t a willing participant.
  • Illegal search – If police didn’t have probable cause for a search, evidence may be excluded. No drugs = no charges.

Federal Sentencing Guidelines

Federal cases use sentencing guidelines that consider the defendant’s criminal history and specifics of the case. This gives judges more flexibility, but guidelines still recommend long sentences – e.g. up to 293 months for high-level meth trafficking.

Lawyers negotiate to reduce offense levels under the guidelines. Things like:

  • Having a minor role in the crime
  • Accepting responsibility by pleading guilty
  • Providing substantial assistance to prosecutors

Each can lower the sentencing range by several months or even years.

State Laws and Sentencing

State laws vary widely in how they penalize distribution. Some states have mandatory minimums, others have more flexible sentencing guidelines. And some states are more “tough on crime” than others.

For example, Alabama has very strict sentences like life without parole for trafficking large quantities. While California has no mandatory minimums, and judges can grant probation for some drug felonies.

An experienced local lawyer knows the laws and typical sentences, and can negotiate better outcomes in that court system.

Getting Charges Dropped or Reduced

Besides sentencing, a lawyer may be able to get charges reduced or even dropped by:

  • Identifying illegal police conduct
  • Negotiating plea bargains
  • Helping you enter pretrial diversion programs

Diversion programs defer prosecution for those with little or no criminal history who complete drug treatment and testing. Graduates can avoid a criminal record.

How a Lawyer Helps

Facing drug distribution charges is scary, but a lawyer experienced in drug crimes can help by:

  • Conducting an independent investigation of your case
  • Identifying weaknesses in the prosecution’s evidence
  • Raising every possible defense to fight the charges
  • Negotiating for dropped or reduced charges
  • Helping you avoid mandatory minimums and seek the lowest possible sentence

With an experienced lawyer fighting for you, there are always options. Don’t lose hope. The consequences may not be as severe as you fear.
