Make no mistake about it: If you have been told by the Internal Revenue Service that your case is being referred to its Criminal Investigations Division, you are already in serious trouble. You need to hire an experienced tax attorney immediately. Failure to do so will almost certainly result in you owing hundreds of thousands of dollars in fines and penalties. You are also very likely to be sentenced to a long term of incarceration.
Because so few cases are referred each year for prosecution — only about 3,000 cases per year are handled by the Criminal Investigation Division of the IRS — the mere fact that your case has been sent to the CI Division is an indication that the IRS believes they have a slam-dunk case to send you to prison for a long time. Maximum fines for a tax fraud conviction are up to $250,000 for individuals and $500,000 for corporations. In addition to this, those convicted of tax fraud will often end up owing all of their recalculated back taxes as well as penalties and fees that can amount to more than 100 percent of the back taxes owed. In short, a criminal prosecution for tax evasion or fraud is likely to ruin your life for years to come.
Luckily, however, very few people are actually charged with tax fraud or evasion. The 3,000 cases referred to the IRS’ Criminal Investigations Division only amount to a tiny fraction of the more than 1.5 million Americans who are selected for auditing each year. But this doesn’t mean that you are in the clear if you have merely been selected for auditing. In fact, anytime the IRS makes contact with you, whether by mail audit or summons to come in for an in-person visit with an agent, you should always contact a qualified tax attorney. It could save you hundreds of thousands of dollars, endless headaches and help you avoid the possibility of prison.
