Penal Code 12022.4 PC – Aiding or Abetting a Felony with a Firearm

By Spodek Law Group | July 8, 2021

California Penal Code 12022.4 PC: The Firearm Sentencing Enhancement Law

Introducing Penal Code 12022.4 PC

Penal Code 12022.4 PC is a law that seeks to deter anyone from providing, or attempting to provide, a firearm to someone else with the intent of aiding or abetting that person in committing a felony. The law is enforced in California, and it carries with it harsh consequences for anyone found guilty of violating it.

Sentencing Enhancements Under Penal Code 12022.4 PC

PC 12022.4 provides for various sentencing enhancements for individuals who break the law. If a person provides a firearm to someone else for the purpose of aiding or abetting them in the commission of a felony, they could face an additional one, two, or three years in state prison. This term will be added on top of the sentence for the underlying felony offense, and it is subject to the court’s discretion.

When sentencing a defendant under PC 12022.4, the judge must consider any aggravating or mitigating circumstances. In the absence of any such circumstances, the defendant will be sentenced to the medium term, which is two years in state prison. At the time of the sentence, the judge must explain the reasoning behind their decision.

Defenses Against PC 12022.4 Charges

Luckily, there are a variety of legal defenses that can be used to challenge PC 12022.4 charges. Defendants may be able to argue that the underlying offense was not a felony, that any confession was coerced, or that they acted under duress. However, these defenses may not always be successful, so it is crucial to consult with a skilled criminal defense attorney to determine the best strategy for your case.

There are other laws related to PC 12022.4 that deal with firearms and felonies. Some examples include California’s Felony Murder Rule (SB 1437), which allows for individuals to be charged with murder if they aid or abet in the commission of a felony resulting in death, and Penal Code 487 PC, which covers grand theft. These offenses, along with many others, can carry severe consequences, so it’s essential to consult with an experienced criminal defense attorney if you’re facing any criminal charges.

Effective Legal Defenses to Challenge PC 12022.4 Charges in California
Learn How to Fight Criminal Charges and Protect Your Rights with Spodek Law Group

If you or someone you know is facing charges under California Penal Code 12022.4, it’s crucial to understand your legal defenses. By presenting a strong legal argument, you can challenge the charges and potentially get them reduced or dismissed.

The “No Felony” Defense: Challenge the Underlying Felony Offense

One of the most effective defenses against PC 12022.4 charges is to prove that no underlying felony offense took place. This defense applies when a person gives a gun to someone else, who then commits a felony offense. However, if the other party only committed a misdemeanor or violation in California, the defense could argue that there was no underlying felony offense to trigger the PC 12022.4 charge.

The “Coerced Confession” Defense: Protect Your Rights Against Police Abuse

Under California law, police officers cannot use excessive force to extract a confession. If the defense can establish that the confession was obtained through police coercion, the judge may exclude it as evidence, or dismiss the case entirely. A coerced confession could occur when a person is pressured or threatened by the police to confess to a crime they did not commit.

The “Duress” Defense: Prove That You Acted Under Threat of Death or Serious Injury

The duress defense can apply in rare situations when a person commits a crime, such as breaking PC 12022.4, because they were threatened with death or serious bodily injury if they refused. This defense requires evidence of a credible and imminent threat, which left the defendant with no reasonable choice but to commit the crime.

Related Offenses to Penal Code 12022.4 PC

When a person uses a firearm to aid or abet a criminal offense, they can face serious criminal charges in California. Here are three related offenses to PC 12022.4:

Penal Code 12022.53: Personally using a firearm during the commission of a serious felony
Penal Code 12022.5: Personally using firearms during the commission of a felony
Penal Code 12022.3: Using a firearm in the commission of a sex crime
If you or someone you know is facing criminal charges under any of these laws, it’s crucial to seek legal representation from a skilled California criminal defense attorney. At Spodek Law Group, we offer a free consultation to discuss your case and explain your legal options. We serve clients throughout California, including Los Angeles, Orange County, San Diego, San Francisco, and more. Contact us today to get the legal help you need.
