Murder is a very common term that is often bandied about in pop culture and other places. Everyone has heard of the concept we’ve chosen to call murder. What this term is widely known, many people are not aware of what it really means. The idea of murder actually has a highly specific meaning rooted in the law. Killing another person is not the same thing as murder. Both legally and morally, people have the right to defend themselves if they feel they are in danger. The technical, legal term for the act of killing another person is homicide. Homicide is not always a criminal act. In many instances, such as during a home invasion, people have the right to kill another human being. However, in certain instances that are largely clearly legally defined under existing American laws, this right can lead to both civil and criminal charges.

The Definition

In general, in order to be considered murder, an action must fulfill two essential criteria. The first is what is known as an unlawful killing. That means it is not allowed under law. What is considered legally justified can vary by state. For example, in Florida, this is the kind of action that may fall under the what is known as the stand your ground law. This law allows people to defend themselves under certain circumstances that may not apply in other jurisdictions.

Malice Aforethought

The second criteria that must be satisfied in order for an action to be considered murder is what is known as malice aforethought. Malice aforethought is a very confusing term that has been subject to judicial interpretation over the years. What it essentially means is the act of killing was done without the legal right to do so. It also means legally that the person who killed someone else had no excuse for his actions. That person was not threatened in any way.

Malice aforethought is actually a fairly complicated rule. You don’t have to deliberately kill someone to be be guilty of this act. For example, if you harm someone and then they die, even if you did not intend to kill them when you hurt them, this can lead to a murder charge. If you hit someone over the head with a brick and that person goes to the hospital and dies as a result of your hitting them you can be charged with murder even if they didn’t die immediately after you hit them.

Reckless Disregard

Reckless disregard is part of the process of determining if an action falls under the category of murder. This means that your actions could have lead to bodily injury and you knew it. For example, if you encounter a group of people marching while you are driving and you deliberately choose to plow into the crowd instead of stopping, you can be charged with murder if someone should die as a result of your willful failure to respect human life.

Degrees of Murder

Like many other legal actions, murder is divided into certain levels. You can be charged with either first degree or second degree murder. Each charge has certain definitions and certain potential penalties. Society as a whole considers some forms of murder both more dangerous and more morally culpable than other kinds of actions.

In order for an action to be considered first degree murder, it must meet certain legal criteria. The killing has to be thought about in advance. For example, a man might have planned to poison his wife’s food and purchased poison in advance before making her dinner. This means that deliberation and premeditation were part of their actions before the wife died. Time to think about and reflect on a person’s actions before they do so matters. It means the person had the chance to avoid killing someone else but willfully chose to engage in murder.

A person can also be charged with this form of murder if they are engaging in another crime while the murder took place. If someone was robbing a bank with a gun and a teller died because the gun went off by accident during the robbery, the bank robber can still be charged with first degree murder.

A murder charge of any kind is a very serious legal matter. Those who are convicted of this crime can face all sorts of very serious penalties up to and include the death penalty. At the very least, a convicted murder will face years in prison and the loss of a professional license. This is why it is imperative to hire a good lawyer.
