The Criminal Court Process in Riverside
The criminal court process starts with an arrest. Unless the crime being charged was extremely serious, or the defendant is deemed a flight-risk or a threat to public safety , the jail will release the defendant on bail or his or her own recognizance (Release OR).
In some scenarios, the District Attorney’s office might determine that there’s not enough evidence to prosecute. In such cases, the defendant has the right to petition for a seal of the arrest records after the applicable statute of limitations passes.
In most other cases, the District Attorney will press formal charges. The defendant is required to appear at an arraignment hearing, which is a short court hearing where the judge reads the charges. Depending on the details of the case, defendants are allowed to skip this hearing, as long as they hire their own private attorney to appear in their place.
