Flammable items with a flash point of 150 degrees Fahrenheit or below, such as gasoline, are also considered caustic chemicals.

Determining the Basis for Charges: Willful and Malicious Intent

Assault with caustic chemicals is a serious crime that requires willful and malicious intent. This means that the perpetrator must have knowingly committed the act with the intent to injure or disfigure another human being. Accidentally spilling caustic chemicals on someone does not constitute a violation of this statute.

If convicted of assault with caustic chemicals, the perpetrator will face felony charges that can result in a prison sentence of two to four years. They may also be fined up to $10,000 or have that amount added to their prison sentence. A conviction for this violent crime will be considered a strike under California’s Three Strikes Law. The defendant may be sentenced to probation but will still have to serve up to 12 months in a county jail. Additionally, they may be required to pay restitution to the victim, obey protective orders, perform community service, and attend therapy or probation appointments.
