Brooklyn Criminal Possession of Marijuana – A Conversation

Marijuana laws in New York have changed a lot recently, making things pretty confusing for folks in Brooklyn. Let’s talk through what’s legal now, what’s still illegal, and what it all means if you get caught with weed.Back in March 2021, New York legalized recreational marijuana use for adults 21 and over. That means it’s now legal to possess up to 3 ounces of pot and smoke it pretty much anywhere you can smoke cigarettes. Growing up to 6 plants at home is also allowed. This is great news for smokers in Brooklyn! No more worrying about getting in trouble just for lighting up a joint.But that doesn’t mean marijuana is totally free and clear now. There’s still a bunch of criminal laws around weed possession and sale. And these laws are real serious – we’re talking felony charges and years in prison here. So you gotta be real careful and know what’s legal and what’s not.Let’s break it down:

Possession

  • It’s legal to have up to 3 ounces of marijuana on you. Anything more than that and you can be charged with a crime.
  • 4-16 ounces is a misdemeanor charge called Criminal Possession of Marijuana in the 3rd Degree. That’s up to 1 year in jail.
  • 16 ounces to 5 pounds is a felony called Criminal Possession of Marijuana in the 2nd Degree. That’s up to 4 years in prison.
  • 5-10 pounds is another felony, Criminal Possession of Marijuana in the 1st Degree. Now you’re looking at up to 7 years behind bars.
  • More than 10 pounds is the big one – Criminal Possession of Marijuana in the 1st Degree. This can get you locked up for 15 years!

So if you’re carrying around pounds of weed in Brooklyn, be real real careful. The cops don’t play around with that.

Selling

Giving away or selling any amount of marijuana is still illegal in New York. Here’s the penalties:

  • Giving away 2 grams or less or selling any amount up to 25 grams is a misdemeanor. Up to 1 year in jail.
  • Selling 25 grams – 4 ounces is another misdemeanor. Again, up to 1 year behind bars.
  • 4 ounces – 16 ounces is a felony called Criminal Sale of Marijuana in the 3rd Degree. Up to 4 years prison.
  • Selling 16 ounces to 5 pounds is a felony too – Criminal Sale of Marijuana in the 2nd Degree. That’s another 4 years maximum.
  • Finally, selling over 5 pounds is the big one – Criminal Sale of Marijuana in the 1st Degree. This can land you up to 15 years in prison!

So if you’re thinking of dealing even small amounts of pot in Brooklyn, think again. Sale and distribution is still very illegal and you can get some real serious prison time.

What Happens If You Get Caught?

If you’re busted with weed in Brooklyn, what happens next? Well first the cops will arrest you and take you to the station. They’ll search you, fingerprint you, take your photo, and lock you in a cell. Then later on you’ll see a judge who will set bail – meaning you’ll have to pay money to get out of jail while your case moves forward.The prosecutor will look at the details of your case and decide what charges to file against you.
