If you live in Queens, and are under an order of protection due to domestic violence, you need to walk a very tight rope. It is not uncommon for both males and females to violate order of protection, which isn’t very smart. Protection orders are put in place for a reason. These are usually filed when one party believes they are in danger due to some type of implicit threat of violence. If you have violated an order of protection, you need to seek out legal help as soon as possible. The courts do not take order protection violations lightly. You could end up in jail and even lose your parental rights.

An order of protection means that you cannot contact the filing party for any reason. This means at their home, workplace, in the park or by following them from point A to point B. Any violation of this order will likely result in the police being called. Order of protection prohibits the offender from stalking, harassing and threatening. If they can ascertain that you have violated the protection order, you will be arrested immediately. An attorney can help your situation if you need a defense.

The courts take order of protections very serious. Far too often, individuals who are under protection orders have injured or killed spouses, girlfriends and even family members of the filing party. Order of protection can come with serious consequences. The court may order the offending party to additionally pay child support, move out of the residence, forbid them to have a firearm and follow custody orders. If you are in this situation, don’t do anything foolish. Seek out a professional to help you launch a defense.

Orders of protection can come from two places: criminal court and family court.

In criminal court, a protection order can be issued against a person who has committed a criminal act. This can be a person who you have no relationship with, or it can be a family member.

When an order of protection is issued through family court, it usually has something to do with a family or domestic situation. These orders can be issued for family members you live with or a boyfriend, spouse or anyone else you have set up residency with.

Individuals who live in Queens may get protection orders by petitioning family court. You may be eligible in certain situation such as:

  • You are related to the defendant by blood.
  • You are legally married to the defendant.
  • You and the defendant are divorced.
  • You have a child in common.
  • You and the defendant have an intimate relationship.

For criminal cases, a protection order is at the discretion of the District Attorney’s Office. If you have violated an order of protection in Queens and need help, hire a experienced lawyer to handle your case. It is imperative that you get the strongest defense possible.

If you violate a protection order, you will have to face the music. Once you get into court, your attorney will have to convey to the court the reason, if any, why you violated a court order. On rare occasions, there may be extenuating circumstances. However, in most cases, the court will throw the book at you, especially if you have already committed an act of violence against the filer.

The best thing to do is find a good protection order attorney who can plead your case. This may be the only thing keeping you from a stiff fine, prison or both. Call a Queens attorney today so you can formulate a defense.
