What is Eluding Offense?
When an individual receives a signal from a law enforcement officer to stop and intentionally flees or tries to evade them, it is considered eluding in violation of N.J.S.A. 2C:29-2b. Eluding is a serious offense in Hunterdon County, and it is classified as a third-degree crime. However, if the eluding creates a risk of death or injury to any person, it is elevated to a second-degree crime. This risk is presumed when a motorist violates a motor vehicle law during eluding.
Conduct Must Be Knowing
Eluding is a conscious decision. A prerequisite to violating the eluding statute is that the conduct is knowing. This means that the motorist must be aware that they have been signaled to stop and consciously decide to flee to elude the police.
