Spodek Law Group: The Experienced Fort Lauderdale Drug Trafficking Lawyers You Need
Controlled Substance Trafficking: The Most Vigorously Investigated Drug Crime
If you are caught cultivating, manufacturing, distributing, or selling illegal drugs, you can be charged with a federal drug trafficking crime. At Spodek Law Group, our experienced Fort Lauderdale drug trafficking lawyers can help you navigate this serious legal situation.
Drug distribution involves the sale, furnishing, or delivery of a drug, while trafficking is more complicated and involves both the weight of the drugs and the movement of controlled substances from person to person, especially across state lines or with drug smuggling from sources abroad.
Federal drug trafficking is investigated by law enforcement agencies like the FBI, the U.S. Drug Enforcement Administration (DEA), and the Criminal Investigation unit of the IRS and U.S. Immigration Services. As one of the most serious drug crimes, it is crucial to have the right representation on your side.
Proving Guilt Beyond a Reasonable Doubt
The prosecution has the burden of proving guilt beyond a reasonable doubt. If your arrest resulted from wiretapping, questionable search and seizure procedures, or the use of an informant with everything to gain by “snitching,” our team is not afraid to take on the feds. At Spodek Law Group, we know what to expect from the full force of the U.S. government.
We understand that the stakes are high for our clients. With nearly 50 years of combined experience, our attorneys focus on understanding the assistant U.S. attorney’s evidence against you and finding ways to poke holes in that evidence. Attorney Todd Spodek has the expertise to make sure the jury finds plenty of reasons for reasonable doubt.
The Most Severe Penalties of All Drug Crimes
Federal drug trafficking penalties are the harshest of all drug crimes, and punishment is based on several factors, including the type of drug, the quantity, the purity or mixture of the substance, and whether you have been convicted before. Penalties for schedule I and II drugs like heroin, cocaine, and methamphetamines can range from not less than four years to life in prison and fines of up to $5 million.
For marijuana, penalties range from not less than five years or more than 40 years in prison and fines of up to $5 million for 100 to 999 kilograms or 100 to 999 marijuana plants, up to life imprisonment for 1,000 kilograms or more or 1,000 or more marijuana plants, and fines of up to $20 million for two or more prior offenses.
The government may also confiscate any property deemed to have come from the proceeds of your drug trafficking activities, including your home, vehicles, and bank accounts. If you are an immigrant, whether in the United States legally or illegally, you may be deported.
Understanding Drug Trafficking Laws in Florida
Florida statutes define “trafficking” in a controlled substance as knowingly selling, purchasing, manufacturing, delivering, bringing into the state, or having actual or constructive possession of a certain specified amount of that substance. The amounts required for a violation vary according to the substance at issue.
Trafficking of a controlled substance is a more serious offense than possession of that substance, and penalties vary somewhat depending on the substance. For example, an individual found guilty of trafficking in marijuana (cannabis) will face a mandatory minimum sentence of three years in prison and a $25,000 fine if the case involves between 25 to 2000 pounds of marijuana (cannabis) or 300 to 2000 plants.
