In the state of Nevada, terrorism and the threat of terrorism are not to be taken lightly. The penal code in Title 15, Chapter 202, outlines the crimes against public health and safety, including a subcategory specifically dedicated to terrorism offenses.

Making Threats or Conveying False Information

Under this subcategory, the act of making threats or conveying false information in connection to terrorism, weapons of mass destruction, legal weapons, or related conduct, is strictly prohibited and punishable by law. The mere act of making a threat can result in life-altering consequences, even if no harm is inflicted. It is imperative to understand the laws and to take immediate action if accused of wrongdoing.

The Consequences of Conveying False Information

In the thrilling world of terrorism, the law is clear. According to the statute within the terrorism subsection of Chapter 202, making threats or conveying false information concerning acts of terror, weapons of mass destruction, or lethal toxins is a crime that will not be tolerated. The relevant law, N.R.S. 202.448, specifies that it is illegal to use any form of communication, including oral, written, or electronic, to knowingly make a threat or convey false information concerning an act of terror.

The Unlawful Conveyance of Lethal Information

The statute also sends a chilling message to those who dare to convey false information concerning the presence, development, production, or release of weapons of mass destruction, biological agents, chemical agents, radioactive agents, or any other lethal toxins. Such conduct is deemed unlawful and those who engage in it do so at their peril.

The Intent to Cause Fear

For those who find themselves accused of violating N.R.S. 202.448 by conveying threats or false information, the stakes are high. The prosecutor must prove that the accused acted with the intent to injure, intimidate, or alarm someone, or to cause panic or civil unrest. It is irrelevant whether the accused caused injury, intimidation, alarm, panic, or civil unrest. The prosecutor only needs to prove that the accused intended to cause fear or unrest through threats or false information to secure a conviction.

The Consequences of Conveying False Information in Connection with Terrorism or Dangerous Weapons

If you dare to spread false information or make false threats about terrorism or dangerous weapons for extortion or profit, or if you aim to interfere with or cause economic harm to a person, government agency, or any division of local, state, or federal government, you’ll be facing the wrath of N.R.S. 202.448. The law doesn’t care if the disruption or damage occurs, your intention is the only thing that matters.

Beware, a violation of this law is a Category B felony, carrying a penalty that could land you behind bars for a minimum of two years and a maximum of 20 years. Not to mention, a hefty fine of up to $5,000. Are you ready to face the consequences of your actions?

Actions That May Constitute Conveying False Information That A Person Or Property Is In Danger

According to Section 93Q(2), a person may be charged with this offense based on their actions, whether it be through making a statement, sending a document, transmitting an electronic or another message, or even more traditional methods such as reporting to the police or calling an emergency line like 000.

The law has also broadened the scope of this offense to include modern methods of communication, such as sending text messages, emails, or even through social media. So be careful what you say, because the consequences of spreading false information can be severe.

When it comes to the criminal offense of conveying false information that puts a person or property in danger, the police face a daunting task. They must prove each of the following elements beyond a reasonable doubt, with unwavering certainty and clarity:
