Drug trafficking is a serious crime that can land you in jail for many years. According to New York laws, drug trafficking refers to the manufacture, distribution and sale of controlled substances. The extent of drug trafficking varies greatly. The practice may involve local traffickers or large organizations that operate on a national or even global scale.

The New York drug trafficking laws penalize individuals who illegally sell, transport or import controlled substances. The most common substances include heroin, marijuana, cocaine, methamphetamine and LCD. Drug trafficking is a felony and carriers more serious consequences than drug possession. If you are charged with drug possession, the police officers may choose to charge you with trafficking if they suspect you wanted to transport the drugs with the intent to sell them. If they find you with a lot of cash or large amounts of drugs at the time of your arrest, you will most likely be charged with drug trafficking.

However, before you are charged with drug trafficking, the prosecutors must prove that you intended to transfer the drugs to another location. They must also prove that you knew the quantity of the drugs.

Penalties for Drug Trafficking

Drug trafficking is a felony. Crimes categorized as felonies attract serious penalties, including long-term prison sentences. The charges may range from class A to class E felonies. The class by which someone is charged depends on the amount of drugs and whether or not children are involved. Charges tend to be more severe if the trafficking involves children.

Those who are charged with drug trafficking for the first time and are considered by the jury as minor traffickers may face up to two years in prison. Those who are considered major traffickers may face up to 15 years in jail. The minimum fine for any drug trafficking offense is $5,000. The maximum fine is double the profit or commission the offender intended to generate from the drug sale. Some judges may demand a maximum fine of $100,000.

Offenders may also face additional consequences. Those convicted of a class A drug trafficking felony may be required to enroll in a seven-year supervisory program once they are released from prison. Offenders will also have to deal with a bad criminal history and poor reputation. This can make it hard for them to get employed.
