Sometimes, situations can escalate out of control very quickly. These types of situations can lead to you facing criminal charges that you never thought that you would ever face. For example, you might currently be facing charges for assaulting a police officer, and you could be wondering how this situation ever occurred in the first place. Now, you might be wondering what kind of consequences you might be facing and what you can expect to happen next. This can be a very overwhelming and frightening situation to be in, but we can help you every step of the way.
Of course, any type of assault charge is something that should be taken seriously. However, if the charge is related to assaulting a police officer, then the charge might be taken even more seriously in court. If this is something that you are facing, you are definitely not going to want to take the situation lightly.
First of all, you should realize that there are a few different ways that you can be charged for assaulting a police officer. The New York State penal code addresses the charge of “assault on a peace officer, police officer, fireman or emergency medical services professional” in section 120.08. In regards to a police officer, this charge refers to when an individual causes serious physical injury to a police officer with the intent to prevent the police officer from performing his or her duty.
This means that if you assault someone who is a police officer but if you do not do so with the intent of preventing him or her from performing police-related duties, then you could be charged with a more traditional assault charge. Even though this is a serious charge as well, it is generally considered to be a lesser charge than assaulting a police officer.
On the flip side, you could actually be charged and convicted of a charge that is even more serious: aggravated assault on a police officer. This charge is reserved for individuals who seriously injure police officers by using a dangerous weapon while committing the crime.
The penalties for assaulting a police officer can vary based off of the exact charge that you are convicted of. For assault, you could face a class D felony. This means you could face between two and seven years in prison.
Assault on a police officer is a class C felony. For this charge, you could face up to 15 years in prison and up to a $5,000 fine. Aggravated assault on a police officer is a class B felony. If you are convicted of aggravated assault on a police officer, you could face up to 25 years in prison.
There are a few different defenses that your legal team could attempt to use if you are facing felony charges for assaulting a police officer. For example, if you are facing actual assault on a police officer charges but if you were not attempting to prevent the police officer from doing his or her job when the crime was committed, your lawyer could argue this. Talking to your lawyer about the facts can help you get professional advice about how to handle your situation and can give you insight about how an attorney can help you in court.
