Upon receiving notification of an accident resulting in death, the Motor Vehicle Commission director must be notified within 72 hours by the investigating officer. In cases where the accident involved an alleged violation of speeding in excess of 20 miles per hour over the authorized speed limit, driving while intoxicated, careless driving, reckless driving, or leaving the scene of an accident, the director may issue a preliminary license suspension without holding a hearing.
This preliminary suspension takes effect as soon as it is issued and can last up to 45 days until the final (plenary) hearing takes place. If you are facing a suspension due to an accident resulting in death or serious injury, you have the right to request a preliminary hearing. This request must be received no later than 10 days from the date on which the notice of suspension was mailed to you, and a preliminary hearing must be scheduled by the MVC no more than 15 days from the date of the request.
During the preliminary hearing, an administrative law judge will hear witness testimony, review documents, and consider the driver’s history, related summonses, and police reports. The driver and their attorney may also present oral arguments. Based on these factors, the judge will determine whether the preliminary suspension should remain in effect until a final decision can be made at a plenary hearing.
