Choosing the Right Divorce Method for You in New Jersey
When it comes to divorce, there is no one-size-fits-all solution. Every divorce is unique and requires an approach tailored to your specific circumstances. At Spodek Law Group, we understand this and are here to help you choose the best method for your divorce in New Jersey. Here are the differences between litigation, mediation, and arbitration, and how they may benefit you.
If you and your spouse are unable to resolve your issues amicably, you may have to enter the realm of litigation. This is the most formal and costly method of resolving your divorce. Your attorney will file a Complaint for Divorce, and you and your spouse will need to attend a Case Management Conference to determine the issues and establish a discovery track.
During this period, you and your spouse will be required to share information and documents. The process can be lengthy and time-consuming, and experts may need to be hired to prepare reports on property valuations, custody, and other issues. Furthermore, if disputes arise over support or parenting time, you may need to file an application with the court to obtain specific relief.
If your case does not settle during the Early Settlement Panel, you will be ordered to economic mediation, and eventually, an All-Day Intensive Settlement Conference. If you still cannot reach an agreement, your case will go to trial, which is expensive and emotionally taxing. Expect at least an additional two years for a decision from the Appellate Division.
If you and your spouse are willing to work together but cannot reach an agreement, consider mediation. You will then file your Complaint for Divorce, and an uncontested hearing will be held where the judge will only determine whether to grant the divorce.
If you and your spouse want a more private, efficient, and less costly method than litigation, arbitration may be the way to go. An arbitrator, who is usually a skilled attorney or retired judge like Attorney Todd Spodek, will decide the issues that you and your spouse have agreed he or she will decide. You and your spouse will agree in advance if the arbitrator’s decisions will be binding or not.
Arbitration can be less formal than a trial, and scheduling can be more controlled. Although you will have to pay the arbitrator for their time, it can still be a more efficient and less expensive proceeding than litigation. Keep in mind that it is still the judge in your matter, not the arbitrator, who decides whether to grant the divorce.
